Abstract

After the enactment of the Basic Agrarian Law (Law No. 5 of 1960) occurred a fundamental change in the law of Agrarian Indonesia, especially in the law in the land sector. To guarantee legal certainty in the land sector requires the availability of the device in writing, a complete clear and consistently implemented and penyelenngaraan land registration which is effective in accordance with the purpose of registration of land, the Government Regulation No. 37 of 1998, the Government issued Government Regulation No. 37 of 1998 regarding regulation of office Land Titles Registrar. Government Regulation No. 37 of 1998 Article 5 (3) confirms the important functions of land registration for the people of the region that is not in PPAT, Head should be appointed as caretaker, even if there is a village far away and far from PPAT contained in districts / municipality may be designated as a village head PPAT meantime. As PPAT a camat clearly has a responsibility of its own, especially in the process of transition of ownership of the land or the sale and purchase of land, the responsibility is clearly intersect with the boundary authority as PPAT, so it's important to be studied more deeply for improving the role and legal responsibility of the subdistrict head as a PPAT in terms of buying and selling land or transfer of property rights to land. Since the number of regions in Indonesia which still has PPAT and the appointment of a district head as a PPAT meantime as well as educational background camat that have nothing to do with PPAT, here timbulah problems caused by the subdistrict head as a PPAT itself, many camat who deviate and abuse of authority of office. The foregoing is considered dangerous, because once banyk conflicts of law in the land sector is happening in the field that occurs therefore, among others, is the issue of land sales that generated a lot of disputes. In order upholding the rule of law should also be based on the legal aspects of the depressed individuals kesdaran individuals involved, and the need for close supervision by the relevant bodies so that no more camat doing deviation based on the mandate of the Government Regulation No. 24 of 1997. / Setelah diberlakukannya Undang-undang Pokok Agraria (Undang-undang Nomor 5 Tahun 1960) terjadi perubahan yang mendasar pada hukum Agraria Indonesia, terutama pada hukum di bidang pertanahan. Untuk memberikan jaminan kepastian hukum di bidang pertanahan memerlukan tersedianya perangkat tertulis, yang lengkap jelas serta dilaksanakan secara konsisten dan penyelenngaraan pendaftaran tanah yang efektif sesuai dengan tujuan dari pendaftaran tanah menurut Peraturan Pemerintah Nomor 37 Tahun 1998 maka dikeluarkanlah peraturan pemerintah nomor 37 tahun 1998 tentang peraturan jabatan pejabat pembuat akta tanah. Peraturan Pemerintah Nomor 37 tahun 1998 Pasal 5 ayat (3) menegaskan fungsi pentingnya pendaftaran tanah bagi masyarakat maka di wilayah yang belum terdapat PPAT, Camat Perlu ditunjuk sebagai pejabat sementara, bahkan jika ada desa yang jauh sekali letaknya dan jauh dari PPAT yang terdapat di kabupaten/kotamadya dapat ditunjuk kepala desa sebagai PPAT Sementara. Sebagai PPAT seorang camat jelas memiliki tanggung jawab tersendiri khususnya dalam proses peralihan hak milik atas tanah atau jual beli tanah, tanggung jawab tersebut jelas bersinggungan dengan batas wewenangnya sebagai PPAT, sehingga penting untuk dikaji lebih dalam guna penyempurnaan peran dan tanggung jawab hukum dari camat selaku PPAT dalam hal jual beli tanah atau pemindahan hak milik atas tanah. Karena banyaknya daerahdaerah di Indonesia yang masih belum memiliki PPAT dan diangkatnya seorang camat sebagai PPAT Sementara serta karena latar belakang pendidikan camat yang tidak ada kaitannya dengan PPAT, disini timbulah masalah yang disebabkan oleh camat sebagai PPAT itu sendiri, banyak camat yang melakukan penyimpangan dan penyalahgunaan wewenang jabatannya. Hal tersebut di atas dianggap berbahaya, karena begitu banyk konflik hukum di bidang pertanahan yang terjadi di lapangan yang terjadi karenanya, antara lain adalah persoalan jual beli tanah yang banyak menimbulkan sengketa. Guna penegakan kepastian hukum perlu juga dilandasi dengan aspek kesdaran hukum oleh idividu-individu yang terlibat, serta perlunya pengawasan yang ketat oleh badan-badan terkait agar tidak ada lagi camat yang melakukan penyimpangan berdasarkan amanat dari peraturan pemerintah Nomor 24 tahun 1997.
