Abstract

Substitute Notary is someone who is temporarily appointed as a notary to replace the notary who is on leave, sick or temporarily unable to carry out his post as a notary. The position and responsibilities of a Substitute Notary same as Acting Notary Public. Based on the provisions of article 17, paragraph 1 of Law Notary, a Notary and / or Substitute Notary not be allowed to double post. Based on the results of Notary Territory Supervisory Council’s Decision of the Special Province of Jakarta No. 10 / PTS / Mj.PWN.Prov.DKI.Jakarta / XII / 2014, an enforcement mechanism for any violation of the code of ethics Notary and / or Substitute Notary doing double post, already well underway. As for the object of study in this paper is about the responsibility for the notary and / or substitute notary when violated the Law of Notary’s Occupancy and / or notary’s code of conduct in case of concurrent positions, and how the legal status (legal position) and legal capacity (law capacity) Supervisory Council of notaries in handling cases of substitute notary double post. The method of this paper is to use a normative juridical research method. The conclusion of this study is that this is the form of accountability from Notary / Substitute Notary that proven to have violated the Code can wear sanctions in the form of verbal or written reprimands, sanctions in the form of a suspension, and may even be liable to dismissal either respect or disrespect. Notary Supervisory Council, an institution established by the Minister of Law and Human Rights of the Republic of Indonesia, which has the authority to conduct surveillance, investigation and may even impose sanctions when there is a Notary and / or Substitute Notary proven to have committed an offense. The Notary Supervisory Council are the Regional Supervisory Council (Majelis Pengawas Daerah) domiciled at district or city level and are authorized to receive reporting and investigation, Territory Supervisory Council (Majelis Pengawas Wilayah) domiciled in the Capital, and the Central Supervisory Council (Majelis Pengawas Pusat) are both domiciled in the State Capital both is authorized to impose sanctions for violations. The mechanism of enforcement of the code of ethics as well as sanctions against the Substitute Notary who has been doing double post by verdict of the Territory Council (MPW), there have been run in accordance with the regulations and laws in force. / Notaris Pengganti adalah seseorang yang untuk sementara diangkat sebagai Notaris untuk menggantikan Notaris yang sedang cuti, sakit, atau untuk sementara berhalangan menjalankan jabatannya sebagai Notaris. Kedudukan dan tanggung jawab seorang Notaris Pengganti sama dengan Notaris sebagai Pejabat Umum. Berdasarkan ketentuan pasal pasal 17 ayat 1 Undang-Undang Jabatan Notaris seorang Notaris dan/atau Notaris Pengganti tidak diperkenankan melakukan rangkap jabatan. Berdasarkan hasil Putusan Majelis Pemeriksa Wilayah Notaris Provinsi Daerah Khusus Ibukota Jakarta Nomor 10/PTS/Mj.PWN.Prov.DKI.Jakarta/XII/2014, mekanisme penegakan hukum atas adanya pelanggaran kode etik Notaris dan/atau Notaris Pengganti yang melakukan rangkap jabatan, sudah berjalan dengan baik. Adapun yang menjadi objek penelitian dalam penulisan ini yaitu bagaimanakah pertanggungjawaban bagi notaris dan/atau notaris pengganti manakala melakukan pelanggaran Undang-Undang Jabatan Notaris dan/atau kode etik notaris apabila terjadi rangkap jabatan, serta bagaimana legal status (kedudukan hukum) dan legal capacity (kapasitas hukum) Majelis Pengawas Notaris di dalam menangani perkara rangkap jabatan notaris pengganti. Metode penelitian dalam penulisan ini adalah dengan menggunakan metode penelitian yuridis normatif. Kesimpulan dalam penelitian ini adalah bahwa bentuk pertanggungjawaban Notaris/Notaris Pengganti yang terbukti telah melanggar Kode Etik dapat kenakan sanksi berupa teguran secara lisan maupun tertulis, sanksi berupa pemberhentian sementara, dan bahkan dapat dikenakan sanksi berupa pemberhentian baik secara hormat maupun tidak hormat. Majelis Pengawas Notaris, merupakan lembaga yang dibentuk oleh Menteri Hukum dan Hak Asasi Manusia Republik Indonesia yang berwenang untuk melakukan pengawasan, penyelidikan dan bahkan dapat memberikan sanksi apabila terdapat Notaris dan/atau Notaris Pengganti terbukti telah melakukan pelanggaran. Majelis Pengawas Notaris terdiri atas Majelis Pengawas Daerah (MPD) berkedudukan pada tingkat Kabupaten atau Kota dan berwenang untuk menerima pelaporan serta melakukan penyelidikan, Majelis Pengawas Wilayah (MPW) berkedudukan di Ibukota Propinsi, dan Majelis Pengawas Pusat (MPP) berkedudukan di Ibukota Negara keduanya berwenang untuk menjatuhkan sanksi atas adanya pelanggaran. Mekanisme penegakan kode etik serta sanksi terhadap Notaris Pengganti yang telah melakukan rangkap jabatan berdasarkan Putusan Majelis Wilayah (MPW) tersebut, telah berjalan sesuai dengan peraturan dan undang-undang yang berlaku.
