Abstract

As a public official, a notary has a role and a very important function in the society. Notary have the responsibility inherent to his profession personally and legally. Meanwhile, trademark according to Article 1 paragraph 1 of Law No. 15 of 2001 on Trademarks ("Trademark Law 2001") is a sign in the form of images, names, words, letters, numbers, color composition, or a combination of these elements having distinguishing features and used in the trading of goods or services. As a property rights that are intangible, trademark rights can be switched or transferred, including through inheritance, donation and testament. This thesis describes the role of the notary in the transfer of trademark rights through the instrument of inheritance, grants and testament refers to Law No. 2 of 2014 on the Amendment to Law Number 30 of 2004 concerning Notary and Trademark Law in 2001, the Book of the Law of Civil Law and Compilation of Islamic Law. The transfer of trademark rights is typically done with a purchase agreement, while the transfer of trademark rights through inheritance, donation and testament is not yet widely used within the sociality. Prudence, diligence, honesty and activeness of a notary in providing legal advice as well as to socialize about the requirements and the validity of the transfer of trademark rights through inheritance, grants and testament is the obligation of the notary to be improved. Notary have the responsibility of preventive and repressive in preventing and identifying potential disputes that may occur and if the deed is made arising from the dispute. The thesis are prepared with the objective to study and analyze the responsibility of the notary in the transfer of trademark rights in practice, especially through in heritance, donation and testament. / Sebagai pejabat umum notaris memiliki peran dan fungsi yang sangat penting dalam masyarakat. Notaris memiliki tanggung jawab yang melekat pada profesinya secara pribadi dan secara hukum. Sementara itu, merek menurut Pasal 1 angka 1 UndangUndang Nomor 15 Tahun 2001 tentang Merek (“UU Merek 2001”) adalah tanda yang berupa gambar, nama, kata, huruf-huruf, angka-angka, susunan warna, atau kombinasi dari unsur-unsur tersebut yang memiliki daya pembeda dan digunakan dalam kegiatan perdagangan barang atau jasa. Sebagai hak milik yang tidak berwujud, hak atas merek dapat beralih atau dialihkan diantaranya melalui waris, hibah dan wasiat. Tesis ini membahas peran notaris dalam pengalihan hak merek melalui instrumen waris, hibah dan wasiat yang mengacu pada Undang- Undang Nomor 2 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan UU Merek 2001, Kitab Undang-Undang Hukum Perdata dan Kompilasi Hukum Islam. Pengalihan hak merek umumnya dilakukan dengan perjanjian jual beli, sedangkan pengalihan hak merek melalui waris, hibah dan wasiat belum secara luas dimanfaatkan dalam masyarakat. Kehati-hatian, ketelitian, kejujuran dan keaktifan notaris dalam memberikan advis hukum serta melakukan sosialisasi mengenai persyaratan dan keabsahan pengalihan hak merek dengan waris, hibah dan wasiat merupakan kewajiban notaris untuk ditingkatkan. Notaris memiliki tanggung jawab secara preventif dan represif dalam mencegah dan mengidentifikasi potensi sengketa yang mungkin terjadi dan jika akta yang dibuatnya menimbulkan sengketa. Tesis ini disusun dengan tujuan untuk mengetahui dan menganalisa tanggung jawab notaris dalam pengalihan hak merek dalam praktek, khususnya melalui waris, hibah dan wasiat.
