Abstract

This thesis is striving to answer the question on how the rules on recognition and enforcement of foreign arbitral awards of The Republic of Indonesia and the United Kingdom have similarities in implementing the legal principles? In order to answer that question, the writer has conducted a legal research, by using a juridical normative method that refers to the legal norms in the rules, acts, international conventions and jurisprudences; and by using a comparative approach. In this case, by comparing concepts, social and political backgrounds, customs, the functions of the rules and jurisprudences of the Indonesian legal system and the English legal system. The inference of the legal research, in essence, have some similarities that the court should not intervene in the running of the arbitrations where the parties or the arbitrators can resolve issues for themselves, and the arbitral awards are final and binding. Moreover, there are some other similarities in the case of legal principles being used by both countries in the rules to recognize and to enforce the foreign arbitral awards. The similarities are conducted by both countries in implementing: (1) the legal principle of execution power of the foreign arbitral awards; (2) the legal principle of reciprocity; (3) the legal principle of limitation of the differences arising out of legal relationship, which are considered as commercial; (4) and the legal principle of the public order
