Abstract

The development of technology was needed to make investment growmg up. One of technology which can provide investment growing up, especially capital market is scripless trading. By scripless trading, the capital market will growth effective and efficient. Regarding with scripless trading which was implemented in Article 55 Law Number 8 Year 1995 concerning with Capital Market, scripless trading has a major problem such as there is no regulation which regulate evidence instrument regarding with transfer of shares by electronic. In prevailing regulation, Kitab Undang-Undang Hukum Perdata (KUHPerdata) , regulates that all transfer of shares will be legal and binding' each parties if the transfer should be proved with shares. In fact, the transfer of shares by scripless trading still have an evidence instrument is Laporan Rekening Efek (Shares Account Report) in electronic (print-out computer) and issued by PT. Kustodian Sentral Efek Indonesia (Indonesian Shares Central Custodian). All electronic document such as Laporan Rekening Efek is the valid evidence instrument. But till now, there is no regulation that regulates electronic document. So that, all prevailing regulation such as KUHPerdata and Law Number 8 Year 1995 should be revised. The Indonesian Governrnent should add a new clause that all electronic documents especially Laporan Rekening Efek which issued by Custodian are valid evidence instrument.
