Abstract

The entitlement of Mortgage Right on KPR (Housing Loan) Agreement through the use of Power of Attorney on Mortgage Entitlement (Surat Kuasa Membebankan Hak Tanggungan / SKMHT) as a basis for the issuance of Mortgage Entitlement Deed by Public Notary/PPAT (Land Deed Official) toward debtor that is not present in the process of Mortgage entitilement. However, SKMHT does not function as collateral and has not yet given a legal certainty to creditor with preferential rights. Therefore, research is needed on the function of SKMHT and the position of creditor (PT Bank Tabungan Negara) if breach of contract by debtor occurs, especially with regards to the application of Article 1 of Agrarian Minister/Head of Land Agency Regulation No. 4 of 1996 on SKMHT which stipulates that SKMHT (Surat Kuasa Membebankan Hak Tanggungan) is effective until the termination of Primary Agreement. This research is a normative legal research with analytically descriptive approach. The researcher conducted an interview to previously determined respondant, which is Mr. DadangSulaksana, Head of MCL Unit at Bank Tabungan Negara, Jln. Jawa No. 7, Bandung. After doing the research, the Writer found that SKMHT (Surat Kuasa Membebankan Hak Tanggungan) is an Accessoir Aggreement of Principal Agreement which is Credit Agreement. SKMHT shall be followed with the issuance of APHT on unregistered land at the latest 1 (one) to 3 (three) months since the date SKMHT is signed by relevant parties, based on Article 1 of Regulation of State Minister for Agrarian Affairs, SKMHT (Surat Kuasa Membebankan Hak Tanggungan) is to increase the availability needs of residencial for people with lower income, in order to give a more simple process for people while making the APHT (Akta Pemberian Hak Tanggungan). it can also protect the creditor BTN (PT.Bank Tabungan Negara) to have a legal standing as a creditor preference while prosecuting the settlement of their credit. If the debtor is breaching the contract for granting a proper legal position as preferential creditor, then the creditor makes APHT and registering the mortgage right, because SKMHT is only a mortgage entitlement that hasn’t yet granted a proper legal position as preferential creditor. / Membebankan Hak Tanggungan dalam Perjanjian Kredit KPR (Kredit Kepemilikan Rumah) menggunakan Surat Kuasa Membebankan Hak Tanggungan (SKMHT) sebagai kuasa untuk dapat membuat Akta Pemberian Hak Tanggungan oleh Notaris/PPAT (Pejabat Pembuat Akta Tanah) terhadap debitur yang tidak dapat hadir dalam proses pembebanan Hak Tanggungan. Akan tetapi Surat Kuasa Membebankan Hak Tanggungan (SKMHT) bukan sebagai lembaga jaminan melainkan hanya sebagai lembaga kuasa yang belum memberikan kedudukan yang pasti bagi kreditur memiliki hak preferen. Oleh karena itu dilakukan pengkajian mengenai fungsi Surat Kuasa Membebankan Hak Tanggungan (SKMHT) serta kedudukan kreditur ( pihak PT.Bank Tabungan Negara) apabila debitur wanprestasi, dengan diberlakukannya Pasal 1 Peraturan Menteri Agraria / Kepala Badan Pertanahan Nasional Nomor 4 Tahun 1996 mengenai Surat Kuasa Membebankan Hak Tanggungan (SKMHT) yang masa berlakunya sampai berahirnya Perjanjian Pokok. Penelitian yang penulis lakukan menggunakan pendekatan yuridis normatif dan bersifat deskriptif analitis. Penulis melakukan wawancara kepada responden yang telah ditetapkan yaitu : Bapak Dadang Sulaksana Kab.Unit MCL di Bank Tabungan Negara jalan Jawa nomor 7 kota Bandung. Hasil penilitian penulis menunjukkan bahwa: Surat Kuasa Membebankan Hak Tanggungan (SKMHT) merupakan perjanjian accessoir dari perjanjian pokoknya yaitu perjanjian kredit. Surat Kuasa Membebankan Hak Tanggungan (SKMHT) terdapat batasan jangka waktu atas tanah terdaftar wajib diikuti dengan pembuatan Akta Pemberian Hak Tanggungan (APHT) selambatlambatnya 1 (satu) bulan dan 3 (tiga) bulan terhadap tanah yang belum terdaftar, sejak tanggal ditandatangani Surat Kuasa Membebankan Hak Tanggungan (SKMHT) oleh para pihak. Fungsi Surat Kuasa Membebankan Hak Tanggungan (SKMHT) berdasarkan Pasal 1 Peraturan Menteri Agraria Nomor 4 Tahun 1996 adalah untuk tujuan peningkatan pemenuhan kebutuhan hunian bagi masyarakat berpenghasilan rendah, untuk memudahkan kreditur sewaktu-waktu dapat melanjutkan pembuatan Akta Pemberian Hak Tanggungan (APHT), serta untuk melindungi pihak kreditur (Bank Tabungan Negara) memiliki kedudukan hukum sebagai kreditur preferen dalam melakukan pelunasan piutangnya. Apabila debitur wanprestasi untuk memberikan kedudukan kreditur yang preferen, maka kreditur membuat APHT dan mendaftarkan Hak Tanggungan, karena SKMHT hanya sebagai lembaga kuasa yang belum memberikan kedudukan sebagai kreditur yang preferen.
