Abstract

The developing of the legal system in Indonesia especially of land reform can’t seperate from Agrarian Law Policy. Implementation of registration buying and selling former land customary property rights is an activity of Agrarian Law. The cases of this research are how to implement of registration buying and selling former land customary property rights in District Kebon Jeruk, West Jakarta which the object is uncertified, whether registration former land customary property rights and registration of buying and selling at land registry office in West Jakarta already appropriated with rules of law, and finding the obstacles encountered in impelementation of registration and registration of buying and selling land customary property rights. The approaching method in this research is normative , and the type of this research is descriptive analytic. The data is obtained from primary data and secondary data in the form of legislation, libray research, and direct interview in the field. The location of this research was in the West Jakarta. And all data analyzed using qualitative descriptive. The result of this research is the implementation of registration buying and selling former land customary property rights in District Kebon Jeruk almost similar with the general of buying and selling former land customary property rights. Buying and selling is kind of an existed process of the rights transition in the past, regulated in the traditions law, based on “Light and Cash” principal. The registration of buying and selling former land customary property rights is appropiate with the Agrarian Law. The land form registration is vey important for the holders of land rights, for the sake of certainty guaranteed law of its land, especially in District Kebon Jeruk, West Jakarta, in order easily know the legal position of its land. The obstacles of the implementation of registration buying and selling former land customary property rights is there lack of public knowledge on land regulations/ Agrarian Law. / Pembangunan sistem hukum di Indonesia khususnya di bidang reformasi hukum pertanahan, tidak bisa dilepaskan dari kebijakan hukum pertanahan. Pelaksanaan pendaftaran jual beli tanah bekas hak milik adat adalah salah satu kegiatan dalam hukum pertanahan. Masalah yang diteliti dalam penelitian ini adalah Bagaimana pelaksanaan jual beli beli tanah bekas hak milik adat di Kelurahan Kebon Jeruk Jakarta Barat dalam hal ini objek tanah belum bersertipikat, apakah pendaftaran tanah bekas hak milik adat dan pendaftaran jual beli di kantor pertanahan Jakarta Barat sudah sesuai dengan peraturan perundang-undangan yang berlaku, hambatan apa yang ditemukan dalam pelaksanaan pendaftaran tanah bekas hak milik adat, dan pendaftaran jual beli tanah bekas hak milik adat Metode penelitian dengan penelitian normatif dan spesifikasi penelitian deskriptis analitis. Jenis data meliputi data primer dan sekunder. Pengumpulan data melalui penelitian kepustakaan serta wawancara langsung dilapangan. Lokasi penelitian dilakukan di Jakarta Barat. Semua data yang diperoleh tersebut dianalisis secara deskriptif kualitatif Dari hasil penelitian ini diperoleh hasil sebagai berikut : Pelaksanan jual beli tanah bekas hak milik adat di Kelurahan Kebon Jeruk Jakarta Barat hampir sama dengan proses jual beli tanah bekas hak milik adat pada umumnya. Jual beli merupakan proses peralihan hak yang sudah ada sejak jaman dahulu, dan biasanya diatur dalam hukum Adat, dengan prinsip: Terang dan Tunai. Pendaftaran tanah jual beli bekas tanah milik adat sudah sesuai dengan UUPA, pendaftaran tanah sangat penting bagi pemegang hak atas tanah, demi terjaminnya kepastian hukum hak atas tanah yang bersangkutan, khususnya pada kelurahan Kebon jeruk Jakarta Barat, sehingga dengan mudah dapat mengetahui status atau kedudukan hukum tanah tersebut. Hambatan dalam pelaksanaan pendaftaran jual beli tanah bekas hak milik adat adalah adanya kasus-kasus tanah pada umumnya terjadi karena masyarakat kurang mengetahui dan memahami peraturan-peraturan yang berlaku.
