Abstract

One of the ways used to acquire the land is through a waiver. The release of land rights is a legal relationship between releasing the holders of land rights with land acquisition by providing compensation on the basis of the deliberations. Because the gain ground is PT. Babel Citra Mandiri, then PT. Babel Citra Mandiri do compensation to the holders of land rights at the time of the holders of land rights do a waiver upon their land. So the issue is what are the factors that led to the making of an affidavit of submission/release of land rights in district Merawang Bangka district for the benefit of PT. Babel Citra Mandiri and how the legal consequences of the waiver submission/release of the land rights and the effort of PT. Babel Citra Mandiri to master the land rights in Merawang subdistrict of Bangka Regency. To answer this question the normative juridical legal research was conducted against the underlying legislation, with qualitative data processing and the withdrawal of the conclusion logically deductive. Based on the results of the analysis concluded that 1) factors that led to the making of an affidavit of submission/release of land rights in the interest of Bangka Regency Merawang PT. Babel Citra Mandiri that is due to an element of faith is not good which is done by a third party with the letter a forgery done because the land was still Indigenous property rights and first registration has not been made by the holder of rights to the land , there is a mutual trust between the parties so that no mutual suspect 2) legal consequences of waiver submission/release of land rights, land becomes State land and the efforts made by PT. Babel Citra Mandiri to acquire such land is through a petition of rights with Building use rights 3) Suggestion is as the head of the village and the village chief Mudel is supposed to act as a witness and guarantee the truth on the ground in the release of land rights is done by the parties and holders of land rights should have done the first land registry in order not the occurrence of the letter a forgery committed by third parties and has a strong form of authentication certificate of property rights to not in use by other parties. / Salah satu cara yang dipergunakan untuk memperoleh tanah adalah melalui pelepasan hak. Pelepasan hak atas tanah adalah kegiatan melepaskan hubungan hukum antara pemegang hak atas tanah dengan tanah yang dikuasainya dengan memberikan ganti rugi atas dasar musyawarah. Maka permasalahannya adalah Apa saja faktor-faktor yang menyebabkan terjadinya pembuatan surat pernyataan penyerahan/pelepasan hak atas tanah di Kecamatan Merawang Kabupaten Bangka untuk kepentingan PT. Babel Citra Mandiri dan Bagaimana akibat hukum dari surat pernyataan penyerahan/pelepasan hak atas tanah tersebut dan upaya PT. Babel Citra Mandiri untuk menguasai hak atas tanah tersebut di Kecamatan Merawang Kabupaten Bangka. Untuk menjawab pertanyaan ini dilakukan penelitian hukum yuridis normatif terhadap peraturan perundang-undangan yang mendasarinya, dengan pengolahan data secara kualitatif dan penarikan kesimpulan secara logika deduktif. Berdasarkan hasil analisis disimpulkan bahwa 1) Faktor-faktor yang menyebabkan terjadinya pembuatan surat pernyataan penyerahan/pelepasan hak atas tanah di Kecamatan Merawang Kabupaten Bangka untuk kepentingan PT. Babel Citra Mandiri yaitu karena adanya kesengajaan itikad tidak baik yang dilakukan oleh pihak ketiga yang sebagai pejabat yang berwenang 2) Akibat hukum dari surat pernyataan penyerahan/pelepasan hak atas tanah tersebut, tanah menjadi tanah negara dan upaya yang dilakukan oleh PT. Babel Citra Mandiri untuk memperoleh tanah tersebut adalah melalui permohonan hak dengan Hak Guna Bangunan 3) Sarannya adalah Sebagai pejabat yang berwenang hendaknya dalam melakukan pembuatan surat pernyataan penyerahan/pelepasan hak atas tanah selalu bersandar kepada ketentuan-ketentuan yang ada dan baiknya sebagai pejabat yang berwenang seharusnya memberi tahukan kepada para pihak yang melakukan pelepasan hak dan permohonan hak sesuai dengan ketentuan yang berlaku.
