Abstract

The cancellation of the sale and purchase of land is very influential on PPAT deed cancellation and the cancellation of the certificate. Cancellation of this deed which distinguished two cancellations due to the fault of the parties and the cancellation of certificates for error PPAT. Cancellation for error occurs if the parties do not fulfill the requirements valid agreement in accordance with Article 1320 of the Civil Code. Formally factors that may cause PPAT deed be legally flawed, in case of deviation from the process in the manufacture of PPAT deed. The method in this study using normative law. In this study, data collection is done by using the approach of legislation and case approach. The purpose of this study was to determine the PPAT deed of sale which is the authentic deed can be canceled. and to determine the responsibility of the PPAT deed of sale is canceled by the West Jakarta District Court decision No. 169 / Pdt.G / 2013 / PN.JKT.BAR. Based on the results of the study authors, showed that the cancellation of the deed of sale of land to do that if there is an element that does not comply with applicable regulations as a defect in the deed. Both materially and / or formal and responsibilities of the PPAT make a cancellation deed with her position as a notary, the contents of the deed of sale is made between the seller and the buyer otherwise does not have legally binding and it is interpreted by PPAT to be null and void. Thus the certificate on behalf of the buyer based on the deed of sale do not have the force of law again. / Pembatalan jual beli tanah sangat berpengaruh pada pembatalan Akta PPAT dan juga pembatalan sertifikatnya. Pembatalan akta ini dibedakan dua yakni pembatalan karena kesalahan dari para pihak dan pembatalan akta karena kesalahan PPAT. Pembatalan karena kesalahan para pihak terjadi apabila tidak terpenuhinya syarat sah perjanjian sesuai dengan pasal 1320 KUHPerdata. Secara formil faktor yang dapat menyebabkan akta PPAT menjadi cacat hukum, apabila terjadi penyimpangan terhadap proses dalam pembuatan akta PPAT. Metode dalam penelitian ini menggunakan metode hukum normatif. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundangundangan dan pendekatan kasus. Tujuan penelitian ini adalah untuk mengetahui akta jual beli PPAT yang merupakan akta Otentik dapat dibatalkan. dan untuk mengetahui tanggung jawab PPAT terhadap akta jual beli yang dibatalkan berdasarkan putusan pengadilan Negeri Jakarta Barat Nomor : 169/Pdt.G/2013/PN.JKT.BAR. Berdasarkan hasil penelitian penulis, didapatkan hasil bahwa Pembatalan akta jual beli tanah dapat dilakukan yakni apabila terdapat unsur yang tidak sesuai dengan peraturan yang berlaku seperti terdapat kecacatan dalam pembuatan akta. Baik materil dan/atau formil dan tanggung jawab PPAT tersebut membuat pembatalan akta dengan posisi dia sebagai notaris, yang isinya akta jual beli yang dibuat antara penjual dan pembeli dinyatakan tidak mempunyai hukum mengikat dan itu ditafsirkan oleh PPAT dengan batal demi hukum. Dengan demikian sertipikat atas nama pembeli berdasarkan akta jual beli tidak mempunyai kekuatan hukum lagi.
