Abstract

Notary as one of the legal profession, is appropriate role of the Notary also supports law enforcement through the implementation of his profession as a public official authorized to make a legal product that is authentic act which has the power to help create a perfect proof of a legal certainty for the community. The presence of Notary institution in Indonesia must supervised by the government. The supervision aims to enable the Notary fulfill any requirements related to the task performance if Notary position for the society interest because the Notary assigned by government not for themselves but for the society interest. The research method is a normative legal research. The approach used in this research is the approach of legislation and historical approaches. The benefit of using legislation approach is to seek the ratio legis and the basic ontologic of the legislation. Based on the result of research indicates that the supervision of a Notary is conducted by the public court and the supreme court. After the enactment of Law No. 30 of 2004 so the supervision of Notary switch to the Ministry of Justice and Human Rights of the Republic of Indonesia. The authority of Regional Council Supervisor according to Law No. 2 of 2014 provided in article 67 and 70. While the authority of Regional Council Supervisor according to Regulation of the Minister of Justice and Human Rights of the Republic of Indonesia No. M.02.PR.08.10 2004 provided in article 13 and 14. In the context of supervision and guidance to the Notary, Notary Supervisors Council is in position as the party is not only intended to supervise of the code of ethics but also wider aim that Notary can fulfill all obligations set by the Law in force for the protection of the communities. / Notaris sebagai salah satu bentuk profesi hukum, sudah selayaknya peranan Notaris turut mendukung penegakan hukum melalui pelaksanaan profesi jabatannya sebagai pejabat umum yang berwenang membuat suatu produk hukum yaitu akta otentik yang mempunyai kekuatan pembuktian sempurna untuk membantu terciptanya suatu kepastian hukum bagi masyarakat. Kehadiran institusi Notaris di Indonesia memerlukan pengawasan oleh Pemerintah. Adapun yang merupakan tujuan dari pengawasan adalah agar para Notaris ketika menjalankan tugas jabawannya memenuhi semua persyaratan yang berkaitan dengan pelaksanaan tugas jabatan Notaris, demi untuk kepentingan masyarakat, karena Notaris diangkat oleh pemerintah bukan untuk kepentingan diri sendiri tetapi untuk kepentingan masyarakat yang memakai jasanya. Metode penelitian yang dilakukan adalah penelitian hukum normatif. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang – undang dan pendekatan historis. Manfaat penggunaan pendekatan perundangundangan adalah untuk mencari ratio legis dan dasar ontologis lahirnya peraturan perundangundangan. Dari hasil penelitian pengawasan terhadap Notaris dilakukan oleh Peradilan Umum dan Mahkamah Agung maka setelah berlakunya Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris maka kewenangan pengawasan dan pembinaan Notaris beralih ke Kementrian Hukum dan HAM Republik Indonesia. Kewenangan Majelis Pengawas Daerah dalam pengawasan Notaris menurut UU No. 2 Tahun 2014 diatur dalam Pasal 67 dan 70. Sedangkan kewenangan Majelis Pengawas Daerah dalam pengawasan Notaris menurut Peraturan Menteri Hukum dan Hak Asasi Manusia Republik Indonesia No. M.02.PR.08.10 Tahun 2004 diatur dalam Pasal 13 dan Pasal 14. Dalam rangka pengawasan dan pembinaan terhadap Notaris, Majelis Pengawas Notaris berkedudukan sebagai pihak yang melakukan pengawasan tidak hanya ditujukan dalam pentaatan terhadap kode etik tetapi juga bertujuan yang lebih luas yaitu agar Notaris yang menjalankan tugas jabatannya tersebut dapat memenuhi semua kewajiban yang telah ditetapkan oleh peraturan perundang – undangan yang berlaku demi terjaminnya perlindungan kepada masyarakat yang dilayaninya.
