Abstract

As a legal state, Republic of Indonesia warrants a certainty, order, and protection of law by giving a chance to its citizens to get legal evidences or documents in relation to the private law. For that purpose, Notary was given authority to expedite notarial deeds which were admitted by the country as a perfect evidence. Question was emerged on how is the Notary's responsibility under its capacity? Hire Purchase is a variation of sale in which title of rights shall be proceed from seller to buyer if the installment had been fulfilled. In Indonesia, up to the present there has no act which regulated Hire Purchase in particular, therefore Minister of Trade and Cooperative Decree No. 34/KP/II/80 still being the legal basis in order to get the hire purchase license. The question was emerged again regarding who are the subjects and scope of the objects under hire purchase? Under Article 3 of Decree No. 34/KP/II/1980, the Seller is national trading company which must be a legal entity. While there is no restriction on who can become the Buyer, so it is possible for all subjects of law becomes a debtor in Hire Purchase agreement. Article 2 (1) of Decree No. 34/KP/II/1980 stipulates that Hire Purchase’s objects are all durable merchant and technical changes will not be happened, either produced by its own production or production’s product or any other assembling in the country, except if the domestic production cannot deal with that. Thereby, scope of Hire Purchase’s objects are either movable or immovable goods. Associated with the transaction of hire purchase, Notary has an important responsibility in ensuring that the parties which will conduct hire purchase transactions are legally competent parties. Similarly, Notary must ensure that the contracted object is an object that is included in the scope of the object of Hire Purchase by the rules mentioned above. In this study, data collection was done by using normative and conceptual approach. Based on the study’s result it can be concluded that to achieve legal certainty, a Notary is required to have a good knowledge regarding substance of hire purchase before drawing up the authentic deed for the parties. / Sebagai negara hukum, Republik Indonesia menjamin kepastian, ketertiban, dan perlindungan hukum dengan cara memberi kesempatan kepada rakyat untuk memperoleh tanda bukti atau dokumen hukum yang berkaitan dengan hukum perdata. Untuk keperluan tersebut, Notaris diberikan kuasa untuk membuat akta autentik yang diakui oleh negara sebagai alat bukti yang sempurna. Muncul pertanyaan bagaimana tanggung jawab Notaris atas kewenangannya itu? Sewa Beli (Hire Purchase) adalah variasi dari jual beli dimana hak milik atas barang baru berpindah dari penjual kepada pembeli apabila angsuran telah selesai dilakukan. Di Indonesia, sampai saat ini belum ada undang-undang yang mengatur mengenai sewa beli (hire purchase) secara khusus sehingga Keputusan Menteri Perdagangan dan Koperasi Nomor 34/KP/II/80 masih dijadikan acuan untuk mendapatkan izin kegiatan usaha Sewa Beli (Hire Purchase). Muncul lagi pertanyaan mengenai siapa saja subjek dan ruang lingkup objek dalam sewa beli? Berdasarkan Pasal 3 SK No. 34/KP/II/1980, yang dapat menjadi Penjual Sewa hanyalah perusahaan perdagangan nasional yang berbentuk badan hukum. Sedangkan tidak ada batasan mengenai siapa yang dapat menjadi Pembeli Sewa, sehingga dimungkinkan bagi semua subjek hukum menjadi debitur dalam perjanjian Sewa Beli. Pasal 2 ayat (1) SK No. 34/KP/II/1980 mengatur bahwa objek Sewa Beli adalah semua barang niaga tahan lama dan tidak mengalami perubahan teknis, baik yang berasal dari hasil produksi sendiri ataupun hasil produksi atau perakitan (assembling) lainnya di dalam negeri, kecuali apabila produksi dalam negeri belum memungkinkan untuk itu. Dengan demikian, baik barang bergerak maupun tidak bergerak masuk ke dalam ruang lingkup objek Sewa Beli . Dikaitkan dengan transaksi Sewa Beli, Notaris memiliki tanggung jawab yang penting dalam memastikan bahwa pihak – pihak yang akan melakukan transaksi sewa beli adalah pihak yang cakap. Demikian pula, Notaris wajib memastikan bahwa objek yang diperjanjikan adalah objek yang tercakup dalam ruang lingkup objek Sewa Beli berdasarkan aturan tersebut diatas. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-undangan dan Konseptual. Dari hasil penelitian tersebut dapat disimpulkan bahwa demi tercapainya kepastian hukum, Notaris wajib memiliki pengetahuan yang baik mengenai substansi sewa beli sebelum membuat akta autentik bagi para pihak.
