Abstract

Notary is a public official empowered by the state to serve the public in terms of creating an authentic evidence in civil law which is authentic deed. The deed has a complete burden of proof and legal certainty. Which is why every Minute of Deed shall be stored as part of Notary Protocol in accordance with the Regulation of Notary as stated in Law No. 2 Year 2014. However the case remains that there are still Notary that violated his obligation regarding the storage, as stipulated in the Surabaya State Court Decision No.1008/Pdt.G/2011/Pn.Sby. The purpose of this research is to identify the legal status or position of un-deposited deed as part of Notary Protocol and the responsibility arising from it. This research utilizes a juridical normative method that focuses on legal norms by analyzing legal regulation regarding Public Notary. / Notaris adalah pejabat umum yang diberi kewenangan oleh Negara untuk melayani masyarakat dalam hal membuat alat bukti tertulis dalam bidang hukum perdata yaitu akta otentik. Akta Otentik memiliki kekuatan pembuktian yang sempurna serta memberikan kepastian hukum, sehingga dalam melaksanakan jabatannya harus berpegang pada Peraturan Jabatan Notaris yang tertuang pada Undang-Undang Nomor 2 Tahun 2014. Namun pada kenyataannya, masih terdapat Notaris yang melanggar kewajiban jabatannya dalam hal penyimpanan Minuta Akta sebagai bagian dalam Protokol Notaris seperti yang terdapat dalam Putusan Pengadilan Negeri Surabaya No.1008/Pdt.G/2011/Pn.Sby Tujuan penelitian yakni untuk mengetahui status hukum atau kedudukan dari akta yang tidak disimpan sebagai bagian dari Protokol Notaris serta bagaimana pertanggungjawaban Notaris atas pelanggaran tersebut. Metode penelitian dalam penulisan ini adalah yuridis normatif yang menekankan pada norma-norma hukum dengan menganalisa peraturan perundang-undangan terkait dengan jabatan notaris.
