Abstract

Pada tanggal 25 Maret 2015, kantor berita Associated Press (AP) mengungkap tindak pelanggaran HAM (Hak Asasi Manusia) berupa perbudakan, penganiayaan, dan penggelapan ratusan Anak Buah Kapal (ABK) asing yang dilakukan oleh PT. Pusaka Benjina Resources di Benjina, Maluku, Indonesia. Para ABK asing yang diperlakukan secara tidak manusiawi tersebut berasal dari berbagai negara antara lain Thailand, Myanmar, Laos, dan Kamboja. Penelitian ini bertujuan untuk mendapatkan gambaran mengenai peran Pemerintah Indonesia dan keterlibatan International Organization for Migration (IOM) dalam mengatasi pelanggaran HAM terhadap para ABK asing di Benjina, dengan terlebih dahulu mendeskripsikan situasi dan kondisi yang terjadi di Benjina. Untuk mencapai tujuan tersebut, penulis menggunakan dua pertanyaan rumusan masalah yang akan dibahas lebih lanjut. Pertanyaan tersebut sebagai berikut: 1.) Bagaimana peran Pemerintah Indonesia dalam menyelesaikan masalah pelanggaran HAM terhadap ABK asing di Benjina tahun 2015? 2.) Bagaimana keterlibatan International Organization for Migration (IOM) dalam mengatasi masalah pelanggaran HAM terhadap ABK asing di Benjina tahun 2015? Dengan menggunakan teori neo-liberalisme, dalam penelitian ini ditemukan bahwa Pemerintah Indonesia dan IOM memiliki peran penting untuk menangani kasus tersebut sehingga diharapkan tidak ada lagi praktik pelanggaran HAM dalam industri perikanan Indonesia. Pemerintah Indonesia bersama dengan IOM segera menindaklanjuti kasus Benjina setelah mendapatkan laporan AP. Baik Indonesia maupun IOM memberikan banyak bantuan berupa bantuan repatriasi, makanan dan non-makanan, kesehatan, reintegrasi, dan hukum./ On 25 March 2015, The Associated Press (AP) office revealed an act of human rights violations in the form of modern slavery, assault, and the abuse of hundreds of ship crew that was committed by PT. Pusaka Benjina Resources in Benjina, Maluku, Indonesia. Those foreign ship crew that were treated inhumanely originated from different countries such as Thailand, Myanmar, Laos, and Cambodia. This research aimed to grasp a picture of the role that The Indonesian Government has and the intervention that the International Organization for Migration (IOM) on the resolution of the committed act on human rights violations against foreign ship crew in Benjina, with first and foremost by describing the situation and condition that was going on in Benjina. For that goal, the writer uses two research questions which will be further discuss. The two questions are: 1.) How did the Indonesian Government played its role in solving the violation of the human rights against the foreign ship crew in Benjina in 2015? 2.) How was the intervention of The International Organization for Migration (IOM) in solving the violation of the human rights against the foreign ship crew in Benjina in 2015. By using neo-liberalism theory, in this research, it has been discovered that both the Indonesian Government and The IOM played a big part in managing the case so that the violation of the human rights will not be committed again in the Indonesian fishing industry. The Indonesian Government in tandem with IOM will further investigate the Benjina case after getting the report from AP. Both Indonesia and IOM gave help in the form of repatriation, food, and non-food, health related, reintegration, and law.
