Abstract

Penelitian ini bertujuan untuk meneliti lebih lanjut mengenai keabsahan akta notaris yang ditandatangani secara elektronik dikaitkan dengan Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris dan Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Penelitian ini menggunakan jenis penelitian hukum normatif yang dilakukan dengan mengkaji dan membahas ketentuan hukum yang berkaitan. Hasil penelitian ini menunjukkan bahwa berdasarkan UU ITE, tanda tangan elektronik dalam akta notaris dapat dikatakan sah sepanjang memenuhi syarat-syarat yang diatur dalam UU ITE, sedangkan berdasarkan UUJN, karena tidak ada ketentuan yang menyebutkan bahwa tanda tangan harus tanda tangan basah, dan tidak ada larangan untuk penerapan tanda tangan elektronik pada akta notaris, maka dimungkinkan untuk dilakukan tanda tangan elektronik pada minuta akta Notaris sepanjang tetap memenuhi persyaratan dalam UUJN. Akibat hukum dari tanda tangan elektronik adalah sah dan pembuktiannya sempurna layaknya akta otentik yang mana harus dilakukan dengan tanda tangan elektronik bersertifikasi agar kekuatan pembuktiannya lebih sempurna. Dengan demikian, karena dasar ketentuan terkait penandatangan akta notaris secara elektronik masih belum memberikan kepastian hukum dan terdapat kekosongan hukum, maka perlu adanya pembenahan regulasi / This research aims to further examine the validity of notary deeds signed electronically in relation to Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary Public and Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. This research uses a type of normative legal research which is carried out by reviewing and discussing related legal regulations. The results of this research indicate that based on the ITE Law, the electronic signature in a notary deed can be said to be valid as long as it meets the requirements stipulated in the ITE Law, whereas based on UUJN, since there is no provision states that the signature must be a wet signature, and there is no prohibition for the application of an electronic signature on a notary deed, it is possible to do an electronic signature on the notary deed as long as it still meets the requirements in the UUJN. The legal consequence of an electronic signature is that it is valid and has perfect evidence like an authentic deed which shall be done with a certified electronic signature so that the power of evidence is more perfect. Thus, since the basic provisions related to the signing of notary deeds electronically still do not provide legal certainty and there is a legal vacuum, it is necessary to reform the regulations
