Abstract

Notaris sebagai salah satu profesi hukum harus menjalankan jabatannya sesuai dengan Undang-Undang Nomor 2 Tahun 2014 tentang Jabatan Notaris dan Kode Etik Notaris. Namun seiring meningkatnya jumlah Notaris di Indonesia, mendorong para notaris untuk melakukan segala cara dalam rangka mendapatkan klien secara instan dengan melanggar ketentuan Undang-Undang dan Kode Etik Notaris yang berakibat timbulnya persaingan tidak sehat antar sesama notaris. Didalam praktik terdapat berbagai bentuk dari persaingan tidak sehat tersebut seperti mempromosikan jabatan baik melalui media cetak atau elektronik, atau penetapan tarif jasa notaris di bawah standar. Penetapan tarif di bawah standar bisa dilakukan oleh notaris langsung kepada klien yang datang kepadanya atau bisa juga dengan cara melakukan kerjasama dengan pihak-pihak tertentu seperti developer, bank, dan lain-lain. Dalam kerjasama tersebut biasanya terjadi negosiasi mengenai tarif yang akan ditetapkan oleh notaris dan biasanya notaris akan memberikan tarif yang lebih rendah dari standar yang telah ditetapkan. Merujuk pada ketentuan Undang-Undang Jabatan Notaris dan Kode Etik Notaris, notaris yang melakukan pelanggaran terkait honorarium dapat mengakibatkan notaris tersebut dikenakan sanksi berupa teguran lisan, teguran tertulis, dan pemberhentian sementara./ Notary as a legal profession must carry out his position in accordance with Law Number 2 of 2014 concerning Notary Position and Notary Code of Ethics. However, with the increasing number of Notaries in Indonesia, it encourages notaries to do everything they can to get clients instantly by violating the provisions of the Law and the Notary Code of Ethics which results in unfair competition between notaries. In practice, there are various forms of unfair competition, such as promoting a position either through print or electronic media, or sub-standard notary service rates. Determination of substandard rates can be done by the notary directly to clients who come to him or it can also be done by collaborating with certain parties such as developers, banks, and others. In such cooperation, there is usually a negotiation regarding the rate to be determined by the notary public and usually the notary will give a lower rate than the predetermined standard. Referring to the provisions of the Notary Position Law and the Notary's Code of Ethics, a notary who commits a violation related to honorarium may result in the notary being subject to sanctions in the form of verbal warning, written warning, and temporary dismissal.
