Abstract

Kepemilikan suatu tanah di Indonesia sudah ada sejak dahulu kala dengan menggunakan sertipikat dan alas hak lainnya yang menandakan kepemilikan hak suatu tanah. Sekarang di Indonesia kepemilikan suatu tanah sebagian besar sudah ditandai dengan adanya sertipikat suatu tanah atau alas hak yang menandakan kepemilikan hak atas tanah. Kepemilikan hak atas tanah dapat dipindah tangan dengan beberapa cara salah satunya dengan melakukan jual beli. Melakukan jual beli tanah harus dilakukan dengan bantuan Pejabat Pembuat Akta Tanah untuk membuatkan akta otentik jual beli tanah. Jaul beli tanah yang dilakukan dihadapan Pejabat Pembuat Akta Tanah dapat dilakukan dengan tidak hadirnya salah satu pihak akan tetapi dengan cara salah satu pihak memberikan kuasa kepada orang lain untuk mewakili Jual Beli. Kuasa yang diberikan memiliki tujuan membantu pemberi kuasa untuk memindahkan suatu hak atas tanah. Kuasa untuk menjual dapat dibantu buatkan oleh Notaris. Pembuatan surat kuasa yang memiliki tujuan baik namun masih banyak kesalahan dalam pembuatannya yang mengakibatkan dibuatnya surat kuasa yang memberikan kuasa penuh kepada penerima surat kuasa, dalam hal ini disebut kuasa mutlak, yang seharusnya kuasa untuk menjual dan pembuatannya harus mengacu pada Instruksi Menteri Dalam Negeri Nomor 14 Tahun 1982 tentang Larangan Penggunaan Kekuasaan Mutlak sebagai Pengalihan Hak Atas Tanah, pada waktu ini. Sekarang Instruksi Pemerintah tersebut telah dicabut dengan Peraturan Kepala Pertanahan Nasional Republik Indonesia Nomor 10 Tahun 2014./Ownership of a land in Indonesia has existed for a long time by using a certificate and other title that indicates ownership of land rights. Ownership of land rights can be transferred in several ways, one of which is by buying and selling. The sale and purchase of land must be carried out with the assistance of the Official for Making Land Deeds to produce an authentic deed of sale and purchase of land. Sale and purchase of land made in front of the Official for Making Land Deeds can be done in the absence of one of the parties, but by means of one party giving power to another to represent the Sale and Purchase The power given has the aim of helping the power-giver to transfer a title to land. The power to sell can be made by a notary. Making a power of attorney that has a good purpose but there are still many mistakes in its making which results in the creation of a power of attorney giving full power to the recipient of the power of attorney, in this case called absolute power, which should be the power to sell and manufacture must refer to Instruction of the Minister of Home Affairs Number 14 1982 concerning the Prohibition of the Use of Absolute Power as Transfer of Rights to Land, at this time. Now this Government Instruction has been revoked by Regulation of the Head of National Land Affairs of the Republic of Indonesia Number 10 of 2014.
