Abstract

Adanya transaksi yang dilakukan secara elektronik merupakan bukti besarnya pengaruh perkembangan ilmu pengetahuan dan teknologi pada setiap bidang kehidupan termasuk bidang perdagangan dan bidang hukum perdata. Notaris sebagai pejabat umum yang diberikan kepercayaan untuk mengemban sebagian tugas negara di bidang keperdataan dituntut untuk memberikan jasa pelayanan dengan memanfaatkan perkembangan teknologi yang ada. Penjelasan Pasal 15 ayat (3) UUJN memberikan kewenangan bagi Notaris untuk mensertifikasi transaksi yang dilakukan secara elektronik. Namun dalam ketentuan tersebut tidak dijelaskan secara spesifik mengenai definisi maupun batasan kewenangannya sehingga untuk menjalankan kewenangannya dalam melakukan sertifikasi elektronik, Notaris harus merujuk pada PERMENKOMINFO Nomor 11 Tahun 2018 dan PP Nomor 71 Tahun 2019 yang membatasi kewenangan Notaris yaitu hanya sebagai otoritas pendaftaran. Penelitian ini dilakukan bertujuan untuk mengetahui bagaimana pengaturan kewenangan otoritas pendafataran sertifikat elektronik oleh Notaris dan implementasinya. Metode penelitian yang digunakan adalah penelitian hukum normatif, oleh karena itu pendekatan yang digunakan adalah pendekatan peraturan perundnag-undangan dan hasil dari penelitian ini dapat diketahui bahwa PERMENKOMINFO Nomor 11 Tahun 2018 dan PP Nomor 71 Tahun 2019 mengharuskan Penyelenggara Sertifikasi Elektronik berupa badan hukum sehingga dalam Sertifikasi Elektronik, kewenangan Notaris hanya sebagai otoritas pendafataran yaitu melakukan pemeriksaan kebenaran dan kelengkapan dokumen dan pengaturan tersebut tidak sesuai dengan tugas, dan kewenangan Notaris sebagaimana telah diatur dalam UUJN./The existence of transactions carried out electronically is evidence of the magnitude of the influence of the development of science and technology in every field of life, including trade and civil law. Notaries as public officials who are entrusted with carrying out some of the country’s civil duties are required to provide services by utilizing existing technological developments. Elucidation of Article 15 paragraph (3) UUJN authorizes Notaries to certify transactions conducted electronically. However, these provisions do not specifically explain the definition or limits of authority so that in order to exercise their authority in carrying out electronic certification, Notaries must refer to PERMENKOMINFO Number 11 of 2018 and Government Regulation Number 71 of 2019 which limit the authority of a Notary, namely only as a registration authority. This research was conducted to determine how the regulation of the authority for electronic certificate registration by the notary public and its implementation. The research method used is normative legal research, therefore the approach used is a statutory regulatory approach, and the results of this research can be seen that PERMENKOMINFO Number 11 of 2018 and Government Regulation Number 71 of 2019 require Electronic Certification Operators in the form of a legal entity so that in Electronic Certification, the authority of the Notary is only as a registration authority, namely to carry out validity checks and completeness of documents and the arrangement is not in accordance with the task, and the authority of a Notary as stipulated in UUJN.
