Abstract

Saat ini perkembangan ekonomi yang sangat pesat mendorong globalisasi, sehingga diperlukan kepastian hukum bagi lembaga-lembaga ekonomi, khususnya bagi lembaga pemberi piutang seperti bank dan lembaga keuangan lainnya, untuk menjamin kembalinya haknya. Banyak benda yang bisa dijaminkan dalam perhutangan, bisa benda bergerak ataupun benda tidak bergerak. Berdasarkan UU Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah, bahwa jaminan adalah suatu tanggungan yang diberikan oleh seorang debitur dan atau pihak ketiga kepada kreditur untuk menjain kewajibannya dalam suatu perikatan. Lembaga jaminan ini diberikan untuk kepentingan kreditur guna menjamin dananya melalui perikatan khusus yang bersifat accessoir dari perjanjian pokok (perjanjian kredit) oleh debitur dengan kreditur. Penerimaan tanah sebagai agunan yang diterima bank tentunya mempunyai tujuan menjamin pelunasan kredit melalui penjualan agunan baik secara lelang maupun dibawah tangan, dalam hal wanprestasi. Dengan berlakunya UUHT, kalangan perbankan amat mengharapkan masalah eksekusi yang dahulu sering timbul pada waktu berlakunya hipotik tidak muncul lagi atau paling tidak dapat dikurangi. Ketidakpraktisan eksekusi hak tanggungan menimbulkan problema baru dalam dunia perbankan. Jalan yang panjang untuk melakukan eksekusi obyek hak jaminan juga dipakai sebagai kesempatan oleh debitur yang nakal untuk mengulur ulur pelunasan bahkan melakukan segala cara untuk melakukan tindakan menyulitkan dan menghindari eksekusi hak jaminan. Berdasarkan latar belakang diatas, maka dirumuskan beberapa permasalahan, bagaimana syarat-syarat yang harus dipenuhi dalam hal mengajukan permohonan sita jaminan yang bersifat eksekutorial kepada PN setempat dan bagaimana upaya hukum yang dilakukan oleh kreditur dalam bertindak apabila perjanjian kredit terjadi wanprestasi, Tujuan dilakukan penelitian ini adalah memberikan wawasan sekaligus mengetahui dan mengidentifikasi kreditur dalam hal mengajukan permohonan sita jaminan yang bersifat eksekutorial kepada PN setempat dan bentuk upaya hukum yang dapat dilakukan dalam perjanjian kredit terjadi wanprestasi. Metode penelitian yang digunakan Penelitian yuridis normatif yang bersifat kualitatif adalah penelitian yang mengacu pada norma hukum yang terdapat dalam berbagai peraturan perundang-undangan, putusan pengadilan, dan diakhiri dengan Kesimpulan beserta saran-saran / Currently, rapid economic development is driving globalization, so legal certainty is needed for economic institutions, especially for creditors such as banks and other financial institutions, to guarantee the return of their rights. Many objects that can be guaranteed under accountability can be movable objects or non-movable objects. Based on Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah, whereas insurance is a liability provided by a debtor and / or a third party to a creditor to protect his obligations in an engagement. This insurance institution is provided for the benefit of creditors to guarantee their funds through a special agreement that is accessoire of the principal agreement (credit or financing agreement) by the debtor with the creditor. Receipt of land as collateral received by the bank certainly has the objective of guaranteeing credit repayment through the sale of collateral either by auction or underhand, in the event that the debtor is in default and / or default. With the enactment of the UUHT, the banking community really hopes that the execution problems that often arose when mortgages were in effect no longer reappear or at least can be reduced. The impractical execution of mortgage rights creates new problems in the banking world. The long road to carry out the execution of the collateral right object is also used as an opportunity by rogue debtors to delay repayment and even do everything they can to make troublesome actions and avoid the execution of insurance rights. Based on the aforementioned background, several problems can be formulated, as follows: what are the conditions that must be met in terms of submitting an application for executorial confiscation to the local District Court and how the legal remedies taken by the creditors in acting if the credit agreement is in default, The purpose of this research is to provide insight as well as to know and identify creditors in the case of applying for executorial collateral to the local District Court and to find out what forms of legal remedies can be taken if the credit agreement occurs in default. The research method used in this study uses qualitative normative juridical research which refers to the legal norms contained in various laws and regulations, court decisions, and ends with conclusions and suggestions.
