Abstract

Bank terkendala dalam penyelesaian kredit bermasalah, tidak dapat langsung eksekusi jaminan, atas dokumen debitur yang dibuat oleh Notaris dan/atau PPAT tidak selesai tepat waktu, akibatnya untuk mendapatkan haknya bank harus melakukan gugatan ke pengadilan negeri guna memperoleh penetapan atau putusan pengadilan, proses tersebut butuh waktu panjang dan biaya yang tidak sedikit. Untuk melihat ketentuan tentang jangka waktu penyelesaian dokumen bank oleh notaris dan/PPAT berupa Surat Kuasa Membebankan Hak Tanggungan (SKMHT) harus diikuti dengan Akta Pemberian Hak Tanggungan (APHT), Sertifikat Hak Tanggungan (SHT) sebagaimana yang diatur pada Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan. Dan akibat hukum perjanjian kredit terhadap dokumen debitur yang dibuat notaris dan/atau PPAT tidak selesai tepat waktu, diperlukan penelitian dan analisis. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan Perundang-undangan dan juga pendekatan kasus yang sudah mendapatkan Putusan Pengadilan Nomor 01/2020 Del.Jo.No. 36/Eks.Pdt/2019. Jo. No. 270/Pdt.G/2015.PN.Jkt.Sel tanggal 10 Januari 2020 serta dengan wawancara langsung pada bank./Banks are constrained in the settlement of non-performing loans, cannot immediately execute collateral, debtor documents made by Notaries and / or PPAT are not completed on time, as a result, to get their rights the bank must file a lawsuit to the district court to obtain a court order or decision, the process requires long time and costs are not small. To see the provisions regarding the period for completing bank documents by a notary public and / PPAT in the form of a Power of Attorney to Charge Mortgage Rights (SKMHT) must be followed by a Deed of Granting Mortgage Rights (APHT), Certificate of Mortgage Rights (SHT) as regulated in Law Number 4 Year 1996 regarding Mortgage Rights. And due to the legal effect of credit agreements on debtor documents made by notaries and / or PPATs not being completed on time, research and analysis are required. In this study, data collection was carried out using a statutory approach as well as a case approach that has already received Court Decision Number 01/2020 Del.Jo.No. 36 / Eks.Pdt / 2019. Jo. No. 270 / Pdt.G / 2015.PN.Jkt.Sel January 10, 2020 as well as by direct interview with the bank.
