Abstract

Penelitian ini membahas kasus tentang pelaku perdagangan daging hewan Anjing dan penganiayaan hewan Anjing yang terjadi di Indonesia lebih detailnya terjadi di wilayah Manado. Penelitian ini menggunakan tipe penelitian Yuridis Normatif dimana pengolahan bahan hukum dilakukan secara studi pustaka. Penelitian ini bertujuan untuk menelaah tindak perdagangan Daging Anjing dan Penganiayaan Anjing melalui Undang-Undang yang tepat untuk diterapkan pelaku yang memperdagangkan Daging Anjing yaitu Pasal 67 ayat (2) Undang-Undang nomor 18 Tahun 2012 Tentang Pangan dan Pasal 302 Kitab Undang-Undang Hukum Pidana (KUHP), Pasal 66 Undang-Undang Nomor 18 Tahun 2009 jo Undang-Undang Nomor 41 Tahun 2014 Tentang Perubahan atas Undang-Undang Nomor 18 Tahun 2009 Tentang Peternakan dan Kesehatan Hewan. Pelaku dalam Kasus ini telah memperdagangkan daging Anjing dimana daging Anjing sendiri bukan termasuk bahan konsumsi(Hewan non Ternak)untuk di konsumsi Manusia dan dalam pengelolaan daging Anjing tersebut, Anjing disiksa dengan keji dan telah dicuri dari orang lain yang memeliharanya. Prinsip Kesejahteraan hewan adalah segala urusan yang berhubungan dengan keadaan fisik dan mental hewan menurut ukuran perilaku alami hewan yang perlu diterapkan dan ditegakkan untuk melindungi hewan dari perlakuan setiap orang yang tidak layak terhadap hewan yang dimanfaatkan manusia, namun pelaku perdagangan daging Anjing ini justru menyiksa Anjing untuk mendapatkan Dagingnya untuk dijual dan dikonsumsi. Total Referensi: 22 Referensi (1978-2019) Kata Kunci : Perlindungan Hewan, Daging Anjing, Hewan non Ternak / This research discusses cases about the traffickers of dog meat and dog abuse that occurred in Indonesia in more detail in the Manado area. This research uses the juridical normative research type where the processing of legal materials is carried out by means of a literature study. This study aims to examine the trafficking of dog meat and dog maltreatment through appropriate laws to apply to perpetrators who trade dog meat, namely Article 67 paragraph (2) of Law number 18 of 2012 concerning Food and Article 302 of the Criminal Code. (KUHP), Article 66 of Law Number 18 of 2009 in conjunction with Law Number 41 of 2014 concerning Amendments to Law Number 18 of 2009 concerning Animal Husbandry and Animal Health. The perpetrator in this case has traded dog meat where the dog's own meat is not included in the consumption material (non-livestock) for human consumption and in the management of the dog's meat, the dog is cruelly tortured and has been stolen from other people who keep it. The principle of animal welfare is all matters relating to the physical and mental state of animals according to the natural behavior of the animal which needs to be applied and enforced to protect animals from being treated improperly by any person to animals that are used by humans, but the perpetrators of this dog meat trade actually torture dogs get the meat to sell and consume.
