Abstract

Notaris merupakan pejabat umum yang mempunyai hak cuti, Notaris yang menjalani cuti wajib menunjuk Notaris Pengganti untuk menjalankan jabatannya untuk sementara waktu sampai masa cuti berakhir, dalam hal Notaris yang diganti meninggal dunia pada masa cuti, notaris pengganti mengajukan kepada MPD sebagai Pejabat Sementara Notaris. Dalam penelitian ini permasalahan yang diangkat adalah bagaimanakah status notaris pengganti apabila notaris yang diganti meninggal dunia pada masa cuti dan bagaimanakah penyelesaian Protokol Notaris Pengganti apabila Notaris yang diganti meninggal dunia pada masa cuti. Metode penelitian yang digunakan adalah penelitian hukum normatif. Dalam penelitian hukum normatif dipergunakan sumber-sumber data sekunder, yaitu buku-buku, peraturan perundang-undangan, teori-teori hukum dan pendapat para sarjana hukum. Dari hasil penelitian dapat disimpulkan bahwa status notaris pengganti apabila notaris yang diganti meninggal dunia pada masa cuti maka notaris pengganti tersebut menjadi Pejabat Sementara Notaris. Penyerahan protokol terhadap Notaris yang meninggal dunia pada saat cuti adalah tugas jabatan Notaris yang dijalankan oleh Notaris Pengganti sebagai Pejabat Sementara Notaris dalam jangka waktu paling lama 30 hari terhitung sejak tanggal Notaris meninggal dunia Pejabat sementara Notaris menyerahkan Protokol Notaris dari Notaris yang meninggal dunia kepada MPD dalam jangka waktu 60 hari sejak masa jabatan sebagai Pejabat Sementara Notaris berakhir. / Notary is a public official who has the right to leave, a Notary who is on leave is obliged to appoint a substitute notary to carry out his position temporarily until the leave period ends, in the event that the replaced Notary dies during the leave period, the substitute notary submits to MPD as a Notary Temporary Officer. In this research, the problem raised is how is the status of the substitute notary if the replaced notary dies during the leave period and how is the replacement notary protocol resolved if the replaced notary dies during the leave period. The research method used is normative legal research. In normative legal research, secondary data sources are used, namely books, laws and regulations, legal theories and opinions of legal scholars. From the research results, it can be concluded that the status of a substitute notary is if the replaced notary dies during the leave period, the substitute notary will become a Notary Temporary Officer. Submission of protocols to Notaries who pass away while on leave is the task of the Notary Public which is carried out by the Notary Substitute as Temporary Notary Officer within a maximum period of 30 days from the date of the Notary's death. a period of 60 days after the term of office as Notary Temporary Officer ends the protocol holder after receipt of the complete documents.
