Abstract

"Sebagai jabatan dan profesi yang terhormat, Notaris pengganti juga mempunyai kewajiban-kewajiban yang harus dilaksanakan secara baik dan benar, baik itu berdasarkan peranturan perundang-undangan yang khusus seperti UUJN ataupun undang-undang lainnya yang mengatur. Kewenangan Notaris pengganti ini juga sama dengan kewengan Notaris yang digantikan, yaitu kewenangan baik secara umum maupun secara khusus berdasarkan peraturan perundang-undangan yang mengatur. Tentunya dalam pembuatan akta oleh Notaris pengganti ini memiliki kewenangan yang sama seperti Notaris yang digantikan, yaitu kewenangan pada pasal 15 UUJN dan tentunya apabila Notaris pengganti melakukan suatu kesalahan ataupun lalai dalam pembuatan akta maka akan dikenakan sanksi sesuai ketentuan yang berlaku seperti tanggung jawab secara perdata, tanggung jawab secara pidana, tanggung jawab berdasarkan UUJN dan juga tanggung jawab berdasarkan Kode Etik Notaris." The authority of the substitute Notary is also the same as the authority of the Notary who is being replaced, namely the authority either in general or specifically based on the governing laws and regulations. Of course, in making deeds by the substitute Notary, this has the same authority as the replaced Notary, namely the authority in article 15 of the UUJN and of course if the substitute Notary makes a mistake or is negligent in making the deed, he will be subject to sanctions in accordance with applicable provisions such as civil liability, criminal responsibility, responsibility based on UUJN and also responsibility based on the Notary Code of Ethics."
