Abstract

"Notaris adalah seorang pengemban jabatan atau biasa kita sebut dengan pejabat umum yang diangkat oleh negara dan juga bekerja untuk pelayanan kepentingan umum, di dalam menjalankan tugasnya seorang Notaris harus berpegang teguh pada peraturan perundang-undangan kenotarisan yang berlaku di Indonesia saat ia menjabat. Dalam Kode Etik Notaris dan Keputusan Mentri Kehakiman dan Hak Asasi Manusia Republik Indonesia adanya ketentuan yang melarang seorang Notaris melakukan suatu bentuk promosi di media sosial maupun elektronik, apa kendala yang di hadapi oleh Majelis Pengawas Notaris di Indonesia ? Penulis meneliti masalah tersebut dengan menggunakan metode penelitian hukum Normatif yang di tunjang dengan beberapa wawancara yang diharapkan dapat membantu menjawab penelitian dan sumber yang diwawancarai adalah para pihak yang bersangkutan seperti Kaskus, Majelis Pengawas dan juga salah satu Notaris di Jakarta. Kemudian pula perbuatan yang dilakukan Notaris tersebut jelas melanggar dan sepatutnya ada sanksi yang dijatuhkan terhadap Notaris tersebut diatur dalam Pasal 6 Ayat (1) Kode Etik Notaris dan Pasal 18 Ayat (4). Dalam kasus ini jelas sang Notaris terbukti bersalah karena melakukanya suatu bentuk promosi diri di Media Sosial, tetapi Dewan Pengawas itu sendiri yang pada hakikatnya untuk mengawasi Notaris tersebut tetapi dikarenakan banyaknya kendala yang di hadapi oleh Dewan Pengawas maka tugas dari Dewan Pengawas itu sendiri tidak berjalan secara efektif dan maksimal, maka berharap agar Dewan Pengawas dapat mengubah peraturan Dewan Pengawas Notaris menjadi lebih tegas dan diharapkan dapat berlaku secara optimal." "Notary is a holder of an office or what we usually call a public official who is appointed by the state and also works for the service of the public interest, in carrying out his duties, a Notary must adhere to the notarial laws and regulations in effect in Indonesia when he is in office. In the Notary Code of Ethics and the Decree of the Minister of Justice and Human Rights of the Republic of Indonesia, there are provisions that prohibit a Notary from doing any form of promotion on social or electronic media, what are the obstacles faced by the Notary Supervisory Council in Indonesia? The author examines this problem by using the Normative legal research method supported by several interviews which are expected to help answer the research and the sources interviewed are the parties concerned such as Kaskus, the Supervisory Council and also one of the notaries in Jakarta. Then also the actions carried out by the Notary are clearly violating and it is fitting that sanctions be imposed on the Notary are regulated in Article 6 Paragraph (1) of the Notary's Code of Ethics and Article 18 Paragraph (4). In this case it is clear that the Notary is found guilty of doing a form of self-promotion on Social Media, but the Supervisory Board itself is essentially to supervise the Notary but due to the many obstacles faced by the Supervisory Board, the task of the Supervisory Board itself does not run smoothly. effective and maximal, it is hoped that the Supervisory Board can change the regulation of the Notary Supervisory Board to be firmer and is expected to apply optimally."
