Abstract

Tesis ini membahas mengenai perjanjian kerjasama antara Badan Pengusahaan Batam dengan Badan Usaha Pelaksana tentang pemberian legalitas kepada Badan Usaha Pelaksana dalam penyelenggaraan jasa pelayanan kebandarudaraan di Bandar Udara Hang Nadim Batam. Permasalahan dalam Tesis ini adalah bagaimana kekuatan hukum perjanjian kerjasama tersebut berdasarkan Pasal 1320 Kitab Undang-Undang Hukum Perdata tentang syarat sahnya perjanjian dan bagaimana kedudukan hukum Badan Pengusahaan Batam sebagai pihak yang memberikan leglitas kepada Badan Usaha Pelaksana menurut peraturan perundang-undangan yang berlaku. Metode yang digunakan dalam penulisan Tesis ini adalah yuridis-normatif. Dalam penelitian yuridis-normatif ini, penelitian akan mengacu kepada peraturan perundang-undangan dan regulasi yang berkaitan dengan isu hukum yang ditangani. Setelah itu, akan dilihat bagaimana penerapan dari peraturan-peraturan tersebut. Hasil penelitian ini menyimpulkan bahwa perjanjian kerjasama tersebut tidak memenuhi syarat sahnya perjanjian “suatu sebab yang halal”. Sehingga seharusnya perjanjian kerjasama tersebut menjadi batal demi hukum karena melanggar hukum. Dengan demikian kedudukan Badan Pengusahaan Batam dalam memberikan legalitas berdasarkan perjanjian kerjasama tidak memiliki kekuatan hukum. / This thesis discusses the cooperation agreement between Batam Indonesia Free Trade Zone and Free Port Authority and Airport Implementing Business Entity regarding the granting of legality to the Implementing Business Entity in the implementation of airport services at Hang Nadim Airport, Batam. The issues of this Thesis are how the legal strength of the cooperation agreement is based on Article 1320 Civil Code regarding the agreement principles and how the legal standing of Batam Indonesia Free Trade Zone and Free Port Authority as the party that gives legality to Implementing Business Entity according to the prevailing laws and regulations. The method that used in this Thesis is juridical-normative. This method will refer to laws and regulations related to the legal issues being addressed. After that, will be viewed about the application of these regulations. This research concluded that the cooperation agreement does not qualify the agreement principles “a cause that is halal”. So that the cooperation agreement should become null and void because it clearly violates the law. The legal standing of Batam Indonesia Free Trade Zone and Free Port Authority as the party that gives legality based on the cooperation agreement has no legal strength.
