Abstract

Notaris adalah pejabat yang berwenang berdasarkan undang-undang untuk membuat akta otentik yang memiliki kekuatan pembuktian sempurna sehingga Notaris berwenang membuat akta otentik terkait peralihan harta dalam bentuk hukum wasiat. Penelitian ini mencoba untuk mengkaji mengenai tanggung jawab notaris selaku pejabat umum terhadap akta wasiat yang dibuatnya dalam pewarisan masyarakat hukum adat karo terkhususnya mengenai pengaruh keberadaan akta wasiat terhadap kedudukan anak perempuan di masyarakat hukum adat karo yang bersifat patrilineal. Metode penelitian yang digunakan adalah yuridis normative empiris Hasil penelitian ini menyimpulkan bahwa seorang Notaris memiliki kewenangan untuk membuat akta wasiat terhadap penghadap dengan garis keturunan adat karo yang hendak mengalihkan harta kekayaannya disebabkan tidak adanya larangan menurut undang – undang dan juga waris adat karo untuk melakukan pengalihan harta kekayaan menggunakan wasiat. Kecakapan seorang Notaris dalam pembuatan akta wasiat dapat dilihat dari kepastian hukum yang tercipta, sehingga seorang Notaris dituntut untuk memahami jiwa hukum adat karo dan hukum nasional yakni berupa yurisprudensi berkaitan dengan hukum waris adat karo khususnya tentang anak perempuan seperti putusan yang terdapat dalam yurisprudensi Nomor 3/Yur/Pdt/2018 yaitu Putusan Mahkamah Agung Tanggal 23 Oktober 1961 Nomor 179 K/Sip/1961 yang merupakan jalan pembuka bagi anak perempuan untuk memperoleh harta waris dalam kedudukan yang sama antara anak laki – laki dengan anak perempuan. Pemahaman seorang Notaris terhadap hukum adat karo dan juga hukum nasional dalam pembuatan akta wasiat bagi penghadap adat karo menjadi langkah strategis Notaris untuk menghindarkan akta yang dibuatnya menjadi dapat dibatalkan dan menghindari perbuatan Notaris yang dapat menyebabkan kerugian pada berbagai pihak serta timbulnya pertanggungjawaban Notaris berdasarkan aspek tanggung gugat perdata, pidana dan administrative/Notary is an authorized official based on law to make an authentic certificate. Therefore, notaries are authorized to make authentic certificate related to wealth transition in the form of wills. This research tries to examine the responsibilities of the notary as general officials against the wills notary made in the testament of the Karo customary law community, especially regarding the effect of the existence of testatement on the position of woman in the patrilineal customary law community of Karo. The research methods used is juridical normative empirical. The result of this research conclude that notary has the authority to make a testament for client with Karo lineage culture who wants to divert their wealth because there is no prohibition according to law and also Karo culture letting people to divert their wealth using testament certificate. The skill of a notary in making of testament can be seen from the legal certainty that is created, hence notary required to understand the spirit of the customary Karo law and national law that is in the form of jurisprudence relating to the traditional karo inheritance law, especially regarding woman offspring such as the decision contained in jurisprudence Number 3/Yur/Pdt/2018 that is supreme court decision on 23 October 1961 Number 179 K/Sip/1961 which is an opening ways for woman to obtain inheritance in the same position between man and woman. Notary’s understanding of the Karo customary law and also national law in making a testament for Karo clients is a strategic step to prevent the certificate to get cancelled and avoiding notaries action that can make some losses to various parties as well as the notary accountability based on the aspect of civil, criminal and administrative liability.
