Abstract

Penelitian ini bertujuan untuk mengetahui kepastian hukum Akta Jual Beli terhadap tanah bertatus Letter C dan kedudukan PPAT terhadap proses transaksi jual beli terhadap tanah berstatus Letter C. Metode penelitian yang digunakan adalah yuridis empiris. Objek penelitian ini adalah Akta Jual Beli (AJB) tanah yang dibuat oleh PPAT di wilayah Kota Depok. Sedangkan, subyek penelitian ini adalah PPAT yang berada di wilayah Kota Depok. Teknik pengumpulan data yang digunakan adalah penelitian kepustakaan dan penelitian lapangan. Data penelitian yang telah terkumpul kemudian dianalisis dengan menggunakan teknik analisis data induktif. Hasil penelitian menunjukkan bahwa (1) Tanah yang berstatus letter C yang dibeli melalui transaksi jual beli dan menghasilkan AJB wajib melakukan pendaftaran tanah untuk memperoleh kepastian hukum. Proses pendaftaran tanah yang berstatus Letter C dapat dibagi menjadi dua macam, yaitu pendaftaran tanah secara sistematik dan pendaftaran tanah secara sporadik. (2) PPAT mempunyai tanggung jawab penuh terhadap AJB yang dibuatnya. Apabila ada jual beli hak atas tanah yang belum didaftarkan atau belum bersertifikat, maka PPAT harus memperhatikan resiko yang akan timbul, sehingga PPAT berwenang menolak untuk membuat AJB. Terkadang persyaratan untuk membuat AJB belum dapat terpenuhi karena tanah yang dibeli belum mempunyai sertifikat, sehingga untuk mengatasi hal tersebut dapat dibuat Perjanjian Pengikatan Jual Beli (PPJB)./This study aims to determine the legal certainty of the Sale and Purchase Deed of land with Letter C status and the position of PPAT in the sale and purchase transaction process of land with Letter C status. The research method used is juridical empirical. The object of this research is the land sale and purchase certificate (AJB) made by PPAT in the city of Depok. Meanwhile, the subject of this research is PPAT in the city of Depok. Data collection techniques used are library research and field research. The research data that has been collected is then analyzed using inductive data analysis techniques. The results showed that (1) Land with letter C status purchased through a sale and purchase transaction and resulting in AJB is required to register land to obtain legal certainty. The process of registering land with Letter C status can be divided into two types, namely systematic land registration and sporadic land registration. (2) PPAT has full responsibility for the AJB it creates. If there is a sale and purchase of land rights that have not been registered or certified, the PPAT must pay attention to the risks that will arise, so that the PPAT has the authority to refuse to make the AJB. Sometimes the requirements for making AJB cannot be fulfilled because the land purchased does not have a certificate, so to overcome this, a Sale and Purchase Agreement can be made (PPJB).
