Abstract

PPAT adalah pejabat umum yang diberikan kewenangan untuk membuat akta-akta otentik mengenai perbuatan hukum tertentu mengenai hak atas tanah atau Hak Milik Atas Satuan Rumah Susun. Peraturan Pemerintah Nomor 24 Tahun 2016 Tentang Perubahan Atas Peraturan Pemerintah Nomor 37 Tahun 1998 Tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah merupakan peraturan terbaru yang diundangkan oleh pemerintah yang mengatur ketentuan mengenai PPAT yang mengubah peraturan terdahulunya yaitu Peraturan Pemerintah Nomor 37 Tahun 1998 Tentang PPAT. Berdasarkan Pasal 12 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 2016 Tentang Perubahan Atas Peraturan Pemerintah Nomor 37 Tahun 1998 Tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah menjelaskan bahwa wilayah kerja PPAT tersebut telah diperluas menjadi satu provinsi tetapi faktanya peraturan tersebut tidak berlaku seperti sebagaimana mestinya karena Pasal 12 Ayat (1) Peraturan Pemerintah Nomor 37 Tahun 1998 Tentang PPAT yang menjelaskan bahwa wilayah kerja PPAT seluas satu kabupaten yang justru diberlakukan saat ini. hal tersebut tentu bertentangan dengan Asas Lex Posterior Derogat Legi Priori yang merupakan salah satu asas hukum dalam pembentukan peraturan perundang-undangan yang menjelaskan bahwa peraturan terbaru dapat mengesampingkan peraturan terdahulunya. Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan tersebut bertentangan dengan Pasal 12 Ayat (1) Peraturan Pemerintah Nomor 24 Tahun 2016 Tentang Perubahan Atas Peraturan Pemerintah Nomor 37 Tahun 1998 Tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah karena peraturan tersebut telah diundangkan tetapi tidak dapat diterapkan seperti sebagaimana mestinya. / PPAT is a public official who is given the authority to make authentic deeds regarding certain legal actions regarding land rights or property rights over apartment units. Government Regulation Number 24 of 2016 concerning Amendment to Government Regulation Number 37 of 1998 concerning Land Deed Making Officials is the latest regulation promulgated by the government which regulates provisions regarding PPAT which amend the previous regulation, namely Government Regulation Number 37 of 1998 concerning PPAT. Based on Article 12 Paragraph (1) Government Regulation Number 24 of 2016 concerning Amendments to Government Regulation Number 37 of 1998 concerning the Position of Land Deed Making Officials Regarding PPAT explains that the PPAT working area has been expanded to become one province but in fact the regulation does not apply as such. It should have been because Article 12 Paragraph (1) of Government Regulation Number 37 Year 1998 concerning PPAT which explains that the PPAT working area is as large as one regency which is currently in effect. This is certainly contrary to the Lex Posterior Derogat Legi Priori Principle which is one of the legal principles in the formation of laws and regulations which explain that the latest regulations can override the previous regulations. Law Number 12 Year 2011 Concerning the Establishment of the Prevailing Laws is contrary to Article 12 Paragraph (1) Government Regulation Number 24 Year 2016 concerning Amendments to Government Regulation Number 37 Year 1998 Concerning the Position Regulation of Land Deed Making Officials because the regulation has been promulgated but cannot be implemented as it should.
