Abstract

The Republic of Indonesia has been one of the fastest-growing economies of the last decade in Southeast Asia. It is strategically placed geographically and is rich in resources. It therefore attracts numerous tourists, investors, and international business partners. There are however some individuals who take advantage of the economic expertise and resources that the country has to offer. This mostly occurs as a result of the negative impacts of established relationships between countries, for example with China,which is the third largest investor in Indonesia after Singapore and the United States of America. The issue that threatens the development of Indonesia as a country is the overflow of illegal Chinese workers who come into the country and end up suppressing the employment levels for the locals. The current law as stipulated in The Minister of Manpower No. 35 of 2015 is not enough to prevent the entry of these Chinese illegal workers, since their numberskeep on fluctuating from time to time. The Republic of Indonesia has triedvariousapproaches to improve investments and attract investors into the country; hence this policy paper will propose new laws that will not limit investments into the country but protect it, specifically in the field of manpower. The Republic of Indonesia should raise the level of employment in the countryto protect its people. The main purpose of this paper is to optimize the work fields and absorption of local manpower based on Foreign Direct Investment (FDI) in Indonesia, using the case study of Chinese Illegal Workers in Indonesia. / Republik Indonesia adalah salah satu negara yang pesat perkembangannya dalam bidang ekonomi dalam beberapa dekade ini. Republik Indonesia juga adalah salah satu negara yang mempunyai letak strategis secara geografis dan kaya akan sumber daya alam. Dengan ini, Republik Indonesia adalah negara yang menarik banyak resipien, seperti turis, penanam modal, dan hubungan internasional. Ada beberapa ketertarikan yang akan menimbulkan dampak negatif terhadap Republik Indonesia dan ada beberapa dari mereka yang akan menggunakan kesempatan tersebut. Ini adalah salah satu yang disebut dengan dampak negatif dari FDI (Foreign Direct Investment). Tiongkok adalah salah satu negara yang merupakan investor terbesar ketiga di Indonesia setelah Singapur dan Amerika. Kasus terpenting yang dapat mengancam perkembangan Republik Indonesia adalah tenaga kerja ilegal asing asal Tiongkok yang berdatangan dan menaikkan angka pengangguran di Indonesia. Hukum yang berlaku sekarang adalah Peraturan Menteri Tenaga Kerja No. 35 Tahun 2015, tidaklah cukup untuk menghindari tenaga kerja asing asal Tiongkok untuk masuk ke Indonesia, ini dapat dibuktikan dengan fluktuasi angka tenaga kerja asing asal Tiongkok. Indonesia membutuhkan banyak investor untuk mengembangkan negara, tetapi Indonesia harus menghindari partisipasi asing dalam konteks ilegal. Adalah benar Republik Indonesia mencoba untuk membuka peluang bagi para investor asing untuk menanamkan modalnya di Indonesia. Namun, yang terpenting adalah bagaimana kita melindungi rakyat kita, yang akan berdampak pada perkembangan Republik Indonesia secara ekonomis dan politis. Secara spesifik, di dalam dokumen kebijakan publik ini akan ada hukum atau peraturan baru yang akan diajukan untuk melindungi rakyat dan negara kita dengan menghindari tenaga kerja asing ilegal tanpa menutup kesempatan investasi yang positif. Adalah bagaimana cara kita mengoptimalisasi lapangan kerja di Indonesia dan menyerap tenaga kerja.
