Abstract

This research discuss the newest trademark dispute case and attract public attention that is the case of the Pierre Cardin trademark, the case is becoming more attractive because Central Jakarta Commercial Court and the Supreme Court decide to rejected the lawsuit filed by the Pierre Cardin. In this research, the method used is normative research method with technique data collection is doing with a library study way. From this research result, the conclusion is that the protection for foreign well-known mark in Indonesia should not be only contained in the provisions of the regulation. However, that commitment must be followed by the practice of law enforcement that is for the protection of foreign well-known mark to be effective and adequate, it is quite noticeable on the considerations on which the decision of Central Jakarta Commercial Court and the Supreme Court on the dispute Pierre Cardin mark, which clearly shows that the judge did not properly interpret the provisions of Article 6 paragraph (1) point b of the Indonesia Trademark Law and its elucidation. / Penelitian ini membahas kasus sengketa merek yang terbaru dan cukup menarik perhatian publik yaitu kasus merek Pierre Cardin, kasus ini menjadi semakin menarik karena Putusan Pengadilan Niaga Jakarta Pusat dan Mahkamah Agung menolak permohonan gugatan pembatalan merek yang diajukan oleh Pierre Cardin. Dalam penelitian ini, metode yang digunakan yaitu metode penelitian hukum normatif dengan teknik pengumpulan data dilakukan dengan cara studi kepustakaan. Dari hasil penelitian dapat disimpulkan bahwa sebaiknya perlindungan terhadap merek terkenal asing di Indonesia bukan hanya sekedar tertuang dalam ketentuan regulasi saja. Namun, komitmen itu juga harus diikuti dengan praktek penegakan hukumnya yaitu agar perlindungan terhadap merek terkenal asing dapat berjalan efektif dan memadai, hal ini cukup terlihat pada pertimbangan-pertimbangan yang menjadi dasar putusan Pengadilan Niaga Jakarta Pusat dan Mahkamah Agung atas sengketa merek Pierre Cardin, yang jelas menunjukkan bahwa Hakim tidak menafsirkan dengan baik ketentuan Pasal 6 ayat (1) huruf b UU Merek beserta penjelasannya.
