Abstract

Pada penulisan tesis ini akan dibahas tentang Peran dan Tanggungjawab PPAT Terhadap Akta Jual Beli yang Mengandung Perbuatan Melawan Hukum. Hal ini dilatarbelakangi karena PPAT pada dasarnya merupakan seorang Pejabat Umum yang mempunyai kewajiban untuk melaksanakan perbuatan hukum sesuai dengan ketentuan yang berlaku yang berasal dari permintaan klien. Namun pada kenyataannya masih sering ditemukan kelalaian dan ketidak hati-hatian sehingga dalam melakukan perbuatan hukumnya, terutama dalam pembuatan akta jual beli menimbulkan kerugian bagi salah satu pihaknya. Bagaimana tanggungjawab PPAT terkait dengan adanya kerugian yang ditimbulkan tersebut karena tidak diterapkannya prinsip terang dan tunai dalam suatu pembuatan akta jual beli? Dalam penelitian ini, penulis menggunakan metode penelitian kepustakaan, dan menggunakan pendekatan perundang-undangan. Dari hasil penelitian, disimpulkan bahwa pertanggungjawaban seorang PPAT dikaitkan dengan adanya kerugian karena tidak diterapkannya prinsip terang dan tunai dalam suatu pembuatan akta jual beli maka PPAT dapat dikenakan sanksi sesuai dengan Peraturan Menteri Agraria dan Tata Ruang / Kepala Badan Pertanahan Nasional Nomor 2 Tahun 2018 tentang Pembinaan dan Pengawasan Pejabat Pembuat Akta Tanah. Dalam hal tersebut, dikatakan bahwa PPAT yang memberikan keterangan tidak benar terhadap suatu akta dan menimbulkan suatu konflik, maka dapat diberhentikan secara tidak hormat. Selain itu PPAT juga dituntut untuk selalu menjalankan prinsip kehati-hatian. Sedangkan sanksi berdasarkan Kode Etik PPAT, yaitu sanksi yang dapat dikenakan terhadap PPAT juga ditetapkan dalam Pasal 6 ayat (1) Kode Etik PPAT. Tetapi untuk mengetahui apakah PPAT tersebut benar melakukan kesalahan dan kesalahannya tersebut adalah murni dari pebuatannya sehingga menimbulkan kerugian bagi salah satu pihak, maka perlu dilakukan pembuktian terhadap PPAT tersebut. Apabila terbukti bahwa PPAT tersebut melakukan kesalahan maka kerugian yang ditimbulkan baru dapat dimintai pertanggungjawaban dari PPAT yang bersangkutan. / In writing this thesis, the role and responsibility of the PPAT against the Sale and Purchase Deed Containing Unlawful Acts will be discussed. This is motivated because the PPAT is basically a General Official who has the obligation to carry out legal actions in accordance with the applicable provisions originating from the client's request. However, in reality, negligence and carelessness are often found so that in carrying out legal actions, especially in the making of the sale and purchase deed, it causes losses for one of the parties. How is the PPAT's responsibility related to the losses incurred due to the failure to apply the principles of light and cash in a sale and purchase deed? In this study, the authors used a library research method, and used a statutory approach. From the results of the research, it was concluded that the responsibility of a PPAT was associated with a loss due to the failure to apply the principles of light and cash in a sale and purchase deed, so PPAT could be subject to sanctions in accordance with the Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency Number 2 of 2018 concerning Guidance and Supervision of Land Deed Making Officials. In this case, it is said that the PPAT which provides false information on a deed and creates a conflict, can be dishonorably discharged. Apart from that, PPAT is also required to always carry out the principle of prudence. Meanwhile, sanctions based on the PPAT Code of Ethics, namely sanctions that can be imposed on PPAT are also stipulated in Article 6 paragraph (1) of the PPAT Code of Ethics. But in order to find out whether the PPAT actually committed a mistake and the mistake was purely the result of what he did, causing a loss to one of the parties, it is necessary to prove the PPAT. If it is proven that the PPAT has made a mistake, then the losses incurred can only be held accountable from the PPAT concerned.
