Abstract

Tanah merupakan benda yang menjadi komponen utama kebutuhan manusia dalam menjamin kelangsungan hidup, karena dari tanah manusia hidup, tumbuh dan berkembang. Tanah merupakan aset penting yang wajib dijaga karena kepemilikannya dapat berlangsung turun-temurun, hal inilah yang menyebabkan tanah menjadi salah satu sumber konflik yang sampai saat ini masih memerlukan perhatian lebih dari pemerintah. Tujuan penulisan tesis ini adalah untuk menganalisis mengenai mekanisme penerapan dan pelaksanaan arbitrase sebagai alternative dispute resolution dalam penyelesaian sengketa pertanahan serta pengaturan kedepannya mengenai penyelesaian sengketa pertanahan. Penelitian ini merupakan penelitian norrmatif yang dilakukan dengan cara menelaah Peraturan Perundang-Undangan, karya ilmiah, buku-buku, jurnal yang berkaitan dengan tema penulisan dengan kata lain menelaah bahan pustaka atau data sekunder. Penelitian ini menggunakan pendekatan konseptual, perundang-undangan, kasus dan filosofis. Dari hasil penelitian ini dapat disimpulkan bahwa saat ini memanglah tepat menggunakan upaya penyelesaian sengketa tanah dengan menggunakan metode alternatif seperti arbitrase, penyelesaian sengketa dengan arbitrase di nilai lebih efektif dalam mengedepankan hasil keputusan penyelesaian sengketa yang berprinsip keadilan dan mengedepankan kepentingan dari kedua belah pihak. Penegakan dan pelaksanaan mengenai upaya penyelesaian sengketa dengan metode alternatif ini harus di laksanakan dengan dukungan dari pihak-pihak terkait, karena dengan metode ini selain memberikan win-win solution pada pihak yang bersengketa, juga membantu mengurangi beban pengadilan dalam menjalankan register perkara. Pemerintah harus segera membentuk sistem dan kebijakan yang tepat dan melakukan pembaharuan hukum agraria agar tidak kaku dan segera membentuk peradilan khusus pertanahan guna memberikan kepastian hukum dan perlindungan hukum bagi para pihak yang bersengketa. / Land is an object which is the main component of human needs in ensuring life sustainability, because from land humans live, grow and develop. Land is an important asset that must be guarded because its ownership can last from generation to generation, this is what causes land to become a source of conflict which until now still requires more attention from the government. The purpose of this thesis is to analyze the mechanism for the implementation of arbitration as an alternative dispute resolution in the settlement of land disputes and future arrangements regarding the settlement of land disputes. This research is a normative research which is carried out by examining the Regulations, scientific papers, books, journals related to the theme, in other words by examining library materials or secondary data. This research uses conceptual, statutory, case, and philosophical approach. From the results of this study it can be concluded that at this time it is indeed appropriate to use land dispute resolution efforts using alternative methods such as arbitration, which is considered more effective in promoting the results of dispute resolution decisions based on the principle of justice and prioritizing the interests of both parties. Enforcement and implementation of dispute resolution efforts with such alternative method must be carried out with the support of the parties concerned, because this method not only provides a win-win solution to the disputing parties, but also helps to reduce the burden on the court in running the case register. The government must immediately establish the right system and policy and carry out reforms of agrarian law so that it is not rigid, and immediately establish a special court for land to provide legal certainty and legal protection for the parties in dispute.
