Abstract

Indonesia needs foreign capital through direct investment activities. Aside from being a source of national economic development financing, the presence of foreign investment also provides many benefits for national economies. With the abundance of foreign investment in Indonesia, there are a lot of infrastructure improvements that lead to increase national economic growth that positively impact people's lives. Foreign investment is also considered to be a good alternative for the government to solve the difficulties of capital in the conduct of national development, because one of the functions of the enhancement of capital investment, especially foreign investment to enter Indonesian investment, technology and skill. Therefore Indonesia as a developing country would need foreign investors. However, this need not cause the government to provide the broadest possible freedom for foreign investment, one of the requirements set is a presidential decree on the negative list of investment for domestic investors and foreign. Activities of foreign investment in Indonesia must not conflict with the Book of the Civil Code Act, rule of law and legal norms of investment companies. To answer the research problems related to the legal aspects of foreign shareholding in the company's investment, the study used the normative law. The main data are the primary legal materials and secondary legal materials collected through the literature study and analyzed qualitatively.
