Abstract

Hunian adalah hal Esensial yang harus dimiliki, maupun dikuasai oleh seorang manusia. hunian dapat berupa rumah yang menempel di tanah maupun satuan rumah susun yang merupakan bagian dari suatu bangunan. Masyarakat bebas memilih hunian mana yang ingin mereka miliki atau kuasai tergantung dari kebutuhan dan kesanggupan mereka. Dalam memilih suatu tempat hunian, manusia memiliki pertimbangan tersendiri berupa keunggulan yang akan mereka dapatkan dari memilih hunian tersebut. Penjual atau penyelenggara rumah atau satuan rumah susun melakukan promosi, untuk menawarkan keunggulan suatu rumah atau satuan rumah susun yang dijualnya. Dari jual beli rumah dan satuan rumah susun timbul suatu perjanjian yang dinamakan Perjanjian Pengikatan Jual Beli. Perjanjian Pengikatan Jual Beli (PPJB) biasanya dibuat sebelum bangunan rumah atau satuan rumah susun sepenuhnya didirikan. Dari masalah tersebut terbitlah Kepmen Perumahan Rakyat No. 11/KPTS/1994 Tentang Pedoman Perikatan Jual Beli Sarusun dan Kepmen Perumahan Rakyat No. 09/KPTS/M/1995 Tentang Pedoman Pengikatan Jual Beli Rumah agar tercipta kepastian hukum bagi Penjual selaku penyelenggara rumah dan satuan rumah susun dan Konsumen selaku pemilik atau penghuni. Pada tahun 2019 terbit Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 11/PRT/M/2019 (PERMEN PUPR 11 Tahun 2019) guna menggantikan peraturan PPJB yang sebelumnya yang dirasa sudah ketinggalan zaman. Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 11/PRT/M/2019 (PERMEN PUPR 11 Tahun 2019) merupakan peraturan terbaru mengenai pedoman PPJB, yang diharapkan mampu memberikan perlindungan hukum yang lebih baik bagi pihak-pihak yang terlibat dalam jual beli rumah dan satuan rumah susun./Occupany is an essential thing that must be owned or controlled by human being. An occupancy can be a house attached to the ground or an apartment unit that is part of a building. People are free to choose which occupancy they want to own or control depending on their needs and capability. In terms of choosing their occupany, people have their own considerations in the form of privilleges they can get from their occupancy. The seller and developer of the house or apartment unit they sell. From the sale and purchase of houses and apartment units, an agreement called the Sale and Purchase Agreement arises. The Sale and Purchase Agreement (PPJB) is usually made before the house building or apartment unit is fully built. From this issue, the Minister of Housing Decree No. 11/ KPTS/ 1994 concerning Guidelines for Sale and Purchase Agreement of apartment unit and Decree of Public Housing No. 9/ KPTS/ M/ 1995 concerning Guidelines for House Buying and Selling Bonds are made in order to create legal certainty for the Seller as the Developer of the house and apartment unit and the Consumer as the owner or occupant. In 2019 the Minister of Public Works and Public Housing Regulation Number 11/ PRT/ M/ 2019 (PERMEN PUPR 11 of 2019) was issued to replace the previous PPJB regulations that were deemed outdated. Regulation of the Minister of Public Works and Public Housing Number 11/ PRT/ M/ 2019 (PERMEN PUPR 11 of 2019) is the latest regulation regarding PPJB guidelines, which is expected to provide better legal protection for parties involved in buying and selling houses and apartment units.
