Abstract
A recent growing problem in the food sector in major cities, including Jakarta, is the existence of unfit food products on the market. The consumers weakness of not knowing the characteristics and forms of those unfit food products has eased the business actors to do fraud in order to achieve maximum profit. The law and implementing regulations have determined the criteria the composition of foods that may or may not be consumed, for the fulfillment of the rights of consumers; the convenience, security, and safety. Both business actors and consumers should be aware of and carry out the predetermined criteria, to avoid future losses. The obligation to ensure the safety of food products, so it doesn't cause harm to the consumers, is imposed to the business actors, because they, who directly involve in the manufacturing process, know the composition and the issues concerning both security and safety in consuming the food products. Unfortunately, the laws received less attention from the business actors, so there are many violations that caused harm to consumers. Losses that suffered by consumers can lead to a dispute, claiming damages or sanctions as a form of business responsibility. This study uses normative legal research with literature research technique. Responsibility is a very important subject in consumer protection law. In cases of violation of consumer rights, it is required discretion in analyzing who should be responsible, and how far the responsibility can be imposed to the business actors.
