Abstract

In accordance with Article 33 verse (2) and (3) of the Constitution of the Republic of Indonesia of 1945, sectors of production which are important for the country and affect the life of the people shall be under the powers of the State, and the land, the waters and the natural resources within shall be under the power of the State and shall be used to the greatest benefit of the people. Oil and Gas is the natural wealth of Indonesia as a source of non-renewable mineral resources which occupies an important position in state development and welfare of the people, so it was under the power of the State and shall be used for the greatest benefit of the people of Indonesia. The regulation of Oil and Gas mining in Indonesia, are ruled by Law Number 22 of 2001 concerning Oil and Gas, and its implementing regulations. To conduct exploration and exploitation of Oil and Gas, Indonesia Government cannot work alone, therefore, BP Migas (as the representative of Government) in cooperation with one of Oil and Gas Mining Contractor in Indonesia, PT Chevron Pacific Indonesia through Production Sharing Contract. In this research the author discuss about the implementation of the production sharing principle in the Contract, the provisions in the Contract, and also about the production sharing pattern in the Contract, based on Indonesia's Oil and Gas regulations. By the research of the author that has been done, the implementation of the production sharing priciple in the Contract between BP Migas with PT Chevron Pacific Indonesia, can be seen from the provisions of Article 1.1 paragraph 1.1.6 in the Contract, stating that the entire production of oil and natural gas obtained in the implementation of the Oil and Gas Operations in the Contract will be divided between BP Migas with PT CPI in accordance with the applicable provisions in the Contract. Then, the author also found that the provisions, as well as the production sharing pattern set in the Contract between BP Migas with PT Chevron Pacific Indonesia, has been in accordance with the provisions of the Laws of Oil and Gas regulations that applicable in Indonesia.
