Abstract

Ketentuan yang diatur baik dalam KUHPerdata Pasal 147 maupun Pasal 29 UU Perkawinan 1974 yang menyebutkan bahwa perjanjian perkawinan hanya dapat dilaksanakan pada waktu atau sebelum perkawinan dilangsungkan, namun setelah keluarnya Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 mempengaruhi sistem hukum perjanjian perkawinan yang diatur dalam UU Perkawinan 1974, dimana pasca putusan Mahkamah Konstitusi tersebut mengalami perubahan secara maknawi terhadap Pasal 29 ayat (1), (3), dan (4) yaitu perjanjian perkawinan dapat dilaksanakan pada saat setelah berlangsungnya perkawinan. Perjanjian perkawinan ini berlaku sebagai Undang-Undang bagi mereka yang membuatnya, juga berlaku bagi pihak ketiga yang memiliki kepentingan terhadapnya. Pada kenyataannya yang terjadi di masyarakat, sebelum dikeluarkannya Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015, masih ada notaris yang mengeluarkan akta Perjanjian Perkawinan yang dilaksanakan setelah perkawinan berlangsung dan berujung pada pembatalan akta tersebut oleh pengadilan. Pada penulisan tesis ini akan dibahas mengenai Tanggung Jawab Notaris Terhadap Akta Perjanjian Perkawinan Yang Dibuat Selama Perkawinan Berlangsung Sebelum dan Setelah Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015. Dari latar belakang tersebut timbul permasalahan Bagaimana tanggung jawab seorang notaris terhadap pembatalan Akta Perjanjian Perkawinan yang dibuat selama perkawinan berlangsung sebelum dan setelah keluarnya Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015? Penulis menggunakan jenis Penelitian Hukum Normatif, khususnya pendekatan yuridis normatif. Pendekatan yuridis adalah suatu pendekatan yang mengacu pada hukum dan peraturan perundang-undangan yang berlaku, sedangkan pendekatan normatif adalah pendekatan yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder terhadap asas-asas hukum serta studi kasus yang dengan kata lain sering disebut sebagai penelitian hukum kepustakaan. / The provisions stipulated in both Article 147 of the Civil Code and Article 29 of the 1974 Marriage Law state that marriage agreements can only be implemented at the time or before the marriage takes place, but after the issuance of the Constitutional Court Decision Number 69 / PUU-XIII / 2015 it affects the legal system of the regulated marriage agreement. in the 1974 Marriage Law, where after the Constitutional Court decision has undergone a meaningful change to Article 29 paragraphs (1), (3), and (4), namely that the marriage agreement can be implemented after the marriage takes place This marriage agreement applies as a law for those who make it, also applies to third parties who have an interest in it. In fact, what happened in society, before the issuance of the Constitutional Court Decision Number 69 / PUU-XIII / 2015, there were still notaries who issued Marriage Agreement deeds which were carried out after the marriage took place and led to the cancellation of the deed by the court. At the writing of this thesis will discuss the Notary's Responsibility Against Marriage Agreement Deed Made During Marriage Before and After the Constitutional Court Decision Number 69 / PUU-XIII / 2015. From this background, the problem arises. How is the responsibility of a notary for the cancellation of the Marriage Agreement Deed made during the marriage before and after the issuance of the Constitutional Court Decision Number 69 / PUU-XIII / 2015? The author uses a type of Normative Legal Research, especially a normative juridical approach. The juridical approach is an approach that refers to the applicable laws and regulations, while the normative approach is an approach that is carried out by examining library materials or secondary data on legal principles and case studies which in other words are often referred to as library law research.
