Abstract

Dalam beberapa tahun terakhir, bidang konstruksi di Indonesia mengalami perkembangan yang besar. Sama seperti bidang lain yang sedang berkembang, masih banyak kesalahan yang terjadi dalam bidang ini, terutama menyangkut perjanjian kontrak. Ada banyak pelanggaran terhadap perjanjian kontrak yang menyebabkan banyak kasus pemutusan kontrak. Dalam banyak kasus, salah satu atau kedua pihak tidak puas dengan penyelesaian yang diambil. Karena itu Federation Internationale Des Ingenieurs Conseils (FIDIC) mengeluarkan sebuah standar kontrak internasional untuk mengatur hubungan kontraktual antara pemilik dengan kontraktor. Untuk mengetahui sejauh mana standar FIDIC telah digunakan baik di Indonesia maupun di luar negeri, dilakukan wawancara dengan seorang contract manager di salah satu perusahaan kontraktor di Indonesia. Penelusuran kasus-kasus melalui internet juga dilakukan. Hasilnya, didapatkan 12 kasus dimana tiga diantaranya baru terancam mengalami penundaan atau pemutusan kontrak. Analisis dilakukan dengan membandingkan kasus-kasus tersebut dengan peraturan yang terdapat di standard peraturan kontrak FIDIC 2006. Dari analisis tersebut, baik di Indonesia maupun di luar negeri, standar peraturan kontrak FIDIC masih belum umum digunakan dalam proyek. Hal ini telah menyebabkan kegagalan pemilik dalam melaksanakan kewajibannya serta masalah keuangan di proyek./ The construction field in Indonesia is having a great development under the past few years. As every other developing field, errors still occur in this field, especially on contract agreement. There are many violations to contract’s agreement that caused numerous contract termination cases. In many cases, one or both parties are not satisfied with the problem solving solution. That is why; the Federation Internationale Des Ingenieurs Conseils (FIDIC) issued an international standard contract to manage contractual relationship between the owner and the contractor. To know how far the standard of FIDIC have been used either in Indonesia or other countries, an interview have been done with a contract manager on one of the contractor company in Indonesia. Some research for contract termination cases that is released on the internet had also been done. As the result, there are 12 cases; three of them are threatened of suspension and termination. The analysis is done by comparing it with the regulations on FIDIC standard conditions of contract 2006. From the analysis, either in Indonesia or other country, FIDIC standard conditions of contract is not common to use on any kind of construction project. This has caused the failure of the owner to fulfill its obligations and financial problem on the project.
