Abstract

Penelitian ini bertujuan untuk menganalisa bagaimana dampak yang diberikan atau mungkin dapat diberikan oleh peraturan atas Dana Float yang ada pada pengaturan uang elektronik oleh Bank Indonesia terhadap penyelenggaraan uang elektronik dan sistem pembayaran di Indonesia. Latar belakang dari penulisan ini dikarenakan oleh semakin pesatnya perkembangan teknologi yang termasuk didalamnya adalah perkembangan atas metode pembayaran di Indonesia dan meraknya kemunculan berbagai uang elektronik di Indonesia namun belum diiringi dengan pengaturan yang mumpuni. Analisis dilakukan dengan metode pendekatan peraturan perundang- undangan, konseptual, dan historis. Sementara untuk jenis data penelitian ini menggunakan data sekunder yang didapat dari berbagai literatur baik hukum ataupun non hukum. Hasil penelitian menunjukkan bahwa pengaturan yang sekarang ada untuk mengatur uang elektronik masih memiliki banyak kekosongan hukum atas definisi- definisi dan/atau korelasi antara konsep yang sebelumnya ada tentang mata uang dan dengan konsep uang elektronik yang notabene masih bersifat baru. Hal inilah yang dapat menyebabkan kerugian kepada masyarakat, terutama pelaku usaha UMKM yang secara kemampuan finansial lebih rentan walaupun menjadi penopang utama perekonomian Indonesia. / This study aims to analyze how the impact that the regulations on Float Funds have on electronic money regulation by Bank Indonesia on electronic money administration and payment systems in Indonesia. The background of this paper is due to the rapid development of technology which includes the development of payment methods in Indonesia and the peacetime appearance of various electronic money in Indonesia, but this has not been accompanied byadequate regulations. The analysis was carried out by using statutory, conceptual, and historical approaches to methods. Meanwhile, for this type of research data uses secondary data obtained from various literatures, both legal and non-legal. The results show that the existing arrangements for regulating electronic money still have many legal gaps over the definitions and / or correlations between the existing concept of currency and the concept of electronic money which is still new. This is what can cause losses to the community, especially MSME business actors who are financially more vulnerable even though they are the main pillars of the Indonesian economy.
