Abstract

Personal data is one of the important things in human life that must be protected. So a personal data protection is needed to guarantee the rights of every human being. This urgency is also seen from the current technological developments which greatly facilitate the exchange of data or information. Until now, Indonesia itself does not have a regulation that specifically regulates the protection of personal data which is still scattered in several regulations. The European Union already has General Data Protection Regulation. Protection of personal data includes the government and the private sector as the party responsible for processing personal data so that under its supervision an independent institution that oversees the protection of personal data is needed. The author will examine the regulation of independent supervisory institutions in the General Data Protection Regulation as well as the optimal implementation of independent supervisory agency based in Indonesia by conducting normative empirical research using primary, secondary and tertiary data types by applying a systematic approach and legal comparisons. The results of this study are that Indonesia does not yet have an independent supervisory agency for the protection of personal data, while there is an independent supervisory authority in countries in the European Union. Based on the General Data Protection Regulation this institution has a major role in monitoring and enforcing the law on personal data protection regulations. Reflecting on the European Union, with the establishment of an independent supervisory institution in Indonesia, supervision of personal data protection can be carried out without any conflict of interest, and this institution will act as a law enforcer that has the authority to impose administrative sanctions.
