Abstract

Pengaruh nepotisme menyebabkan adanya kesenjangan dalam kehidupan berpolitik khususnya dalam pemilihan umum yang diselenggarakan untuk memilih Kepala Daerah dan Wakil Kepala Daerah. Kesenjangan tersebut berpotensi membuka banyak celah yang dapat disalahgunakan dalam proses menuju pemilihan umum. Beberapa peraturan perundangundangan telah dibentuk untuk mengatur pemerintahan daerah dalam segi pemilihan kepala daerah dan wakil kepala daerah secara demokrasi namun dalam praktiknya masih kurang efektif. Tujuan disertasi ini adalah untuk memberikan rekomendasi kepada masyarakat mengenai pengurangan dan pencegahan terhadap tindakan korupsi khususnya dalam perilaku nepotisme yang berkaitan langsung dengan kehidupan politik ataupun di dalam organ politik tersebut. Nepotisme politik di Indonesia juga masih terjadi dan mempengaruhi baik publik maupun birokrasi. Pemilihan umum yang seharusnya dilakukan dengan demokratif namun tetap tidak dapat terlepas dari pengaruh nepotisme yang sudah ada sejak dahulu. Metode penelitian ini menggunakan metode pendekatan sosio-legal, yang bertujuan untuk melihat bagaimana bekerjanya hukum di masyarakat. Penelitian ini lebih banyak menggunakan realitas fakta yang terjadi khususnya dalam kehidupan politik di Indonesia dan melihat bagaimana hukum bekerja di tengah para penegak hukum dan para pembuat kebijakan, mereka yang bekerja dalam jajaran pemerintahan apakah juga memposisikan hukum sebagai landasan satu-satunya dalam menggunakan jabatan dan mengemban kewajiban sebagai penampung aspirasi masyarakat. Spesifikasi penelitian bersifat deskriptif analitis dengan menggunakan metode analisis data secara yuridis kualitatif melalui analisis beberapa peraturan perundang-undangan yang semakin berkembang dari masa ke masa sehingga disertasi ini dapat menunjukan bahwa pemilihan umum yang dilakukan berdasarkan peraturan perundang-undangan yang bebas dari korupsi, kolusi, dan nepotisme / The influence of nepotism causes participation in policial life, especially in general elections held to elect Regional Head and Deputy Regional Heads. The gap has potential to open up many gaps which can be misused in the process towards elections. Several laws and regulations have been formed to regulate the regional government in terms of electing regional heads and deputy regional heads democratically instead of in practice, it is still less effective. The purpose of this dissertation is to provide recommendations to the public regarding the reduction and prevention against the action of corruption and nepotism directly related to the political organ in community. Political nepotism in Indonesia also still occurs and affects both the public society and the bureaucracy. Elections that should be conducted democratically but still cannot be separated from the influence of nepotism that has existed since from the past. This research method uses the socio-legal method which is offered to see how the law works in the society. This research method uses more facts that are needed specifically in political life in political life in Indonesia and looks how the law works in the midst of law enforces and policy makers, those who work in the ranks of the government also position it as a reservoir of people’s aspirations. The research specification is desciprive analytical using qualitative juridical data analysis methods through the analysis of several laws and regulations which have progressed. This dissertation can show that general or region elections based on legislation which are free from corruption, collusion, and nepotism.
