Abstract
Pemerintah Kota Tangerang saat ini belum memiliki aturan yang mengatur terkait penggunaan DKP TKA. Dalam hal pengaturan terkait dengan kewajiban daerah melaksanakan Pendidikan, pelatihan, percepatan alih tekhnologi dan keahlian yang bersumber dari APBD, hanya terdapat dalam Peraturan Walikota Tangerang (PERWAL) Nomor 24 Tahun 2014 Tentang Perpanjangan Izin Mempekerjakan Tenaga Kerja Asing. Bagaimanakah penggunaan Dana Kompensasi TKA, menurut ketentuan Peraturan Perundang- undangan, serta Bagaimanakah penggunaan Dana Kompensasi TKA oleh Pemerintah Kota Tangerang. Penelitian hukum ini dilakukan dengan tujuan untuk memberikan suatu gambaran terkait dengan perbandingan konsep aturan dalam penggunaan Dana Kompensasi TKA yang diberlaku secara nasional, dengan konsep kebijakan penggunaan Dana Kompensasi TKA yang saat ini berlaku dikota Tangerang. penulisan tesis ini dilakukan tidak hanya sebatas untuk mengkaji dan menganalisis efektifitas ketentuan Pasal 47 Undang- undang Nomor 3 Tahun 2013 Tentang Ketenagakerjaan serta Peraturan Presiden Nomor 20 Tahun 2018 tentang Penggunaan Tenaga Kerja Asing, dan Peraturan Walikota Tangerang Nomor 24 Tahun 2014 tentang Perpanjangan Izin Mempekerjakan Tenaga Kerja Asing, tetapi juga dalam lingkup empiris dengan tujuan untuk mengetahui sejauh mana aturan tersebut bermanfaat dalam pembangunan daerah. Dengan mempertimbangkan ketentuan Pasal 47 ayat (1) Undang- undang Ketenagakerjaan, Peraturan Menteri Ketenagakerjaan Republik Indonesia Nomor 20 Tahun 2019 tentang Penatausahaan Penerimaan Negara Bukan Pajak dan Perpres Nomor 20 Tahun 2018 Tentang Penggunaan TKA, Pemerintah Kota Tangerang dapat segera menyusun Perda yang mengatur dan menetapkan bahwa DKPTKA merupakan kompensasi yang harus dibayar oleh pemberi kerja TKA kepada negara atas penggunaan TKA, yang dimaksudkan dalam rangka menunjang upaya peningkatan kualitas sumberdaya manusia Indonesia serta digunakan untuk kepentingan peningkatan alih tekhnologi dan alih keahlian bagi tenaga kerja domestic.

The Tangerang City Government currently has no regulations governing the use of DKP TKA. In terms of regulations related to regional obligations to implement education, training, accelerated transfer of technology and expertise sourced from the APBD, it is only found in the Tangerang Mayor Regulation (PERWAL) Number 24 of 2014 concerning the Extension of Permits to Employ Foreign Workers. How is the use of the Foreign Workers' Compensation Fund, according to the provisions of the Legislation, and How is the use of the TKA Compensation Fund by the Tangerang City Government. This legal research was carried out with the aim of providing an illustration related to the comparison of the conceptual rules regarding the use of the Foreign Workers 'Compensation Fund, which are enforced nationally, with the concept of the policy on the use of the Foreign Workers' Compensation Fund which currently applies in the city of Tangerang. The writing of this thesis is not only limited to reviewing and analyzing the effectiveness of the provisions of Article 47 of Law Number 3 of 2013 concerning Manpower and Presidential Regulation Number 20 of 2018 concerning Use of Foreign Workers, and Regulation of the Mayor of Tangerang Number 24 of 2014 concerning Extension of Permits to Employ Manpower. Foreign work, but also in an empirical scope with the aim of knowing the extent to which these regulations are useful in regional development. By considering the provisions of Article 47 paragraph (1) of the Manpower Act, Regulation of the Minister of Manpower of the Republic of Indonesia Number 20 of 2019 concerning Administration of Non-Tax State Revenues and Presidential Decree Number 20 of 2018 concerning the Use of Foreign Workers, the Tangerang City Government can immediately compile a regional regulation that regulates and stipulates that DKPTKA is a compensation that must be paid by foreign workers to the state for the use of foreign workers, which is intended to support efforts to improve the quality of Indonesian human resources and is used for the benefit of increasing technology transfer and transfer of expertise for domestic workers.
