Abstract

Catcalling as one of the actions or actions that are contrary to decency and categorized as a criminal act is often neglected. This is because the catcalling action is done spontaneously. Many people in Indonesia do not realize that they are victims or perpetrators of catcalling acts. This is due to a lack of understanding of the catcalling action itself. The act of catcalling has unconsciously reduced human rights that a person has, especially the victim. Rights that are violated include the right to feel safe, the right to feel a peaceful life, the right to feel comfortable in activities, the right to feel happy in social life. So that the existence of this catcalling action is important to prevent and eliminate. However, it is still difficult for the perpetrators of the catcalling act to be processed into the legal realm because Indonesian law has not specifically regulated this catcalling act. So that it takes emphasis to prevent catcalling acts, make catcalling perpetrators aware, and provide an understanding of the legal rules of catcalling, especially to victims, the majority of whom are women, that they can bring this case to the realm of law to get justice and to regain their violated human rights. Catcalling in Indonesia is categorized as a criminal act that is against the law and morality. Law enforcement against this catcalling action does not have legal certainty, even the handling and resolution of this catcalling action cannot be resolved firmly. Article 281 paragraph (2) of the Criminal Code and Article 315 of the Criminal Code and Article 34 j.o Article 8 of Law No. 44 of 2008 concerning Pornography and Article 35 j.o Article 9 of Law No. 44 of 2008 concerning Pornography. Meanwhile, to provide protection for victims can use Law No. 31 of 2014 concerning Amendments to Law No. 13 of 2006 concerning Protection of Witnesses and victims as well as Law No. 39 of 1999 regarding Human Rights.
