Abstract

Pemerintah Indonesia telah memberlakukan Undang-undang No. 15 tahun 2001 tentang Merek yang menganut sistem konstitutif, yaitu perlindungan hükum terhadap pemegang hak atas merek baru akan diperoleh apabila merek tersebut sudah didaftarkan (first tofile). Undang-undang tentang Merek sudah 3 (tiga) kali direvisi. Beberapa perubahan penting yang tercantum dalam Undang-undang No. 15 Tahun 2001 tentang Merek, yaitu penetapan sementara pengadilan, perubahan delik biasa menjadi delik aduan, peran Pengadilan Niaga dalam memutuskan sengketa merek, kemungkinan menggunakan alternatif penyelesaian sengketa dan ketentuan pidana yang diperberat. Sebagai bagian penting dari suatu perdagangan, merek adalah tanda pengenal dan tanda pembeda bagi konsumen, yang dapat menggambarkan jaminan kepribadian (individuality) dan reputasi barang dan jasa yang diperdagangkan dipasaran. Lebih dari itü suatu merek dapat memberi status atau gengsi bagi si pemakainya, misalnya merek-merek dibidang fashion. Meskipun Undang-undang No. 15 Tahun 2001 tentang Merek sudah berlaku lebih dari 10 tahun pada kenyataannya pelanggaran masih terus terjadi. Tesis ini ditulis untuk mengkaji beberapa kasus seperti merek busana Cressida dan Damor, POLO dan POLOPLAYER menggambarkan banyaknya pelanggaran merek. Bagaimana implementasi Undang-undang No. 15 T ahun 2001 tentang Merek dan bagaimana kebijakan Pemerintah dalam upaya menghilangkan praktek pemalsuan merek. Penelitian ini ditulis dengan menggunakan metode penelitian hükum normatif dengan pendekatan Undang-undang. Hasil penelitian memperlihatkan bahwa pemahaman masyarakat dan para pelaku usaha mengenai HKI, pemahaman aparat penegak hükum masih lemah. Hal tersebut terjadi karena kurangnya sosialisasi tentang pentingnya Hak Kekayaan Intelektual khususnya mengenai Merek / The Government of Indonesia has enacted Law Number 15 Year 2001 Regarding Trademark Law which adopts a constitutive system, namely the legal protection of the rights holder for the new brand will be obtained if the trademark has been registered (first to file). The law on Trademark has been revised three (3) times and its important changes are listed in Law Number 15 Year 2001 Regarding Trademark Law, which is an interlocutory injunction. The changes are the transition from normal offence to complaint offence, the role of the Commercial Court in deciding the Trademark dispute, the possibility of using alternative dispute resolution and aggravated criminal provision. As an important part of a trade, the brand is the identification and distinguishing mark for consumers, as well as describing the personality insurance (individuality) and the reputation of the goods and services traded in the market. More than that, a brand can give status or prestige for the wearer, for example fashion brands. Although Law Number 15 Year 2001 Regarding Trademark Law already applies more than 10 years, in fact infringement still occurs and lasts. This thesis was written to examine some cases such as fashion brands Cressida and Damor, POLO and POLOPLAYER that describe many Trademark infringements and how the Government policy regarding the effort to eliminate Trademark infringements. The writer examines the problem by using the method of normative legal research with the approach of the Act. The results of the study show that there is still lack of understanding of the public, businesses and law enforcement officers about Intellectual Property Rights are still weak that it was due to lack of dissemination of the importance of Intellectual Property Rights Regarding Trademark Law
