Abstract

Corona Virus Disease 2019 has been declared a pandemic by the World Health Organization (WHO), so prevention efforts are needed to avoid an increase in cases. In the context of prevention efforts, the implementation of health quarantine as regulated in Undang-Undang Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan. Activities to prevent quarantine are carried out by limiting freedom of movement/community activities in an area with the aim of reducing the spread of disease by the government. Freedom of movement is part of human rights, especially personal rights, which basically can be owned by everyone, but in fact, freedom of movement can be limited when the state is in an emergency. However, amidst the enforcement of health quarantine, there are various policies of the central and local governments in overcoming Covid-19, and the authority to determine an area worthy of quarantine lies in the hands of the central government. Research activities carried out using normative legal research methods with a focus on the statutory approach. The research objective is to provide an explanation of the restriction arrangements by the central and regional governments and to provide an ideal picture of the restriction policy in DKI Jakarta Province. The results of the research show that restrictions on freedom of movement which are limited by the government do not violate human rights because health quarantine is organized based on the principle of public interest as regulated in statutory provisions. As well as providing input to the government to form ideal and efficient policies for the regional government of DKI Jakarta Province in implementing activity restrictions when the state is in a health emergency.
