Abstract

The purchase of land sometimes can cause a dispute, one of it is about the purchase of heritage land. This dispute can happen because of bad attitude from someone that sell heritage land without the knowledge of the heirs whereas the heirs is someone that have rights to the heritage land. The dispute over the purchase of heritage land occurred in a District Court Decision Number 99/Pdt.G/2012/PN.SGR. This dispute happened when The Defendant I sold the heritage land to The Defendant II which the heritage land is still belongs to The Plaintiff. The purchase of heritage land between The Defendant I and Defendant II was done without the approval of the Plaintiff so that the Plaintiff sued Defendant I and Defendant II based of their actions against the law (tort law). Tort law is regulated in section 1365 KUHPerdata which is every act of inflicting harm on others, requires that a person who is guilty of causing losses to compensate for the loss. The purpose of this research aims to determine the elements of Tort Law contained in the Dispute of the purchase of heritage land without the knowledge of the heirs in case Number 99/Pdt.G/2012/PN.SGR and to find out the correct procedure to purchase a heritage land. This research is using a normative research method that is based on statutory regulations applicable and case study. The type of data that used in normative research is secondary data. This data is obtained through library research that will be examined through qualitative methods. The qualitative analysis technique method in this research is carried out by inductive analysis process. In this case, the Judges decided to won The Plaintiff because according to customary law, The Plaintiff is still the owner of the heritage land.
