Abstract

Indonesia sebagai negara yang menganut paham welfare state, memiliki konsekuensi bahwa negara juga memiliki kewajiban untuk melindungi warga negaranya. Salah satu perlindungan oleh negara adalah perlindungan hakkekayaan intelektual. Indonesia yang merupakan negara yang heterogen dengan dihuni oleh ratusan bahkan ribuan suku bangsa menyebabkan Indonesia memiliki kekayaan intelektual di bidang indikasi geografis yang begitu banyak. Penelitian ini merupakan penelitian socio legal dimana data empiris mengenai kerajinan logam Tumang dianalisa berdasarkan peraturan perundang-undangan yang berlaku. Penelitian dilakukan pada saat pandemi COVID-19, sehingga pengambilan data empiris dilakukan secara daring dengan melalui wawancara terhadap beberapa narasumber terkait. Dari hasil penelitian didapatkan kesimpulan bahwa peraturan perundang-undangan mengenai perlindungan hukum kekayaan intelektual, khususnya indikasi geografis dipengaruhi perjanjian internasional. Peraturan perundang-undangan yang mengatur mengenai indikasi geografis telah cukup lengkap, meskipun pengaturan yang bersifat teknis melalui peraturan menteri tidak tersedia. Hal tersebut menjadikan salah satu penyebab perlindungan hukum hak kekayaan intelektual pada kerajinan logam Tumang masih kurang efektif. Penyebab lainnya adalah pemerintah daerah masih terlalu fokus pada hal-hal yang bersifat tangible, sehingga kekayaan intelektual yang bersifat intangible kurang mendapat perhatian serta kurangnya pendidikan dan kesadaran dari masyarakat tentang perlindungan hak kekayaan intelektual. / Indonesia as a country that adheres to a welfare state, has the consequence that the state also has an obligation to protect its citizens. One of the protections by the state is the protection of intellectual property rights. Indonesia, which is a heterogeneous country inhabited by hundreds or even thousands of ethnic groups, has caused Indonesia to have intellectual property in so many geographical areas. This research is a socio legal research where empirical data on Tumang metal crafts is analyzed based on the applicable laws and regulations. The research was conducted during the COVID-19 pandemic, so empirical data collection was carried out online by means of interviews with several related sources. From the research results, it can be concluded that the laws and regulations regarding the protection of intellectual property laws, especially geographical indications are influenced by international agreements. The statutory regulations governing geographic indications are quite comprehensive, although technical regulations through ministerial regulations are not available. This makes one of the reasons for the ineffective protection of intellectual property rights in Tumang metal crafts. Another reason is that local governments are still too focused on tangible matters, so that intangible intellectual property gets less attention and lack of education and awareness from the public about the protection of intellectual property rights.
