Abstract

The phenomenon of plagiarism as a violation of law and academic ethics occurs in the form of the use of ideas, ideas, thoughts, writings, data and information of others by not mentioning the source, and all that perceived as if it came from him. Efforts to prevent and control plagiarism have been regulated in several laws, and implementing regulations. However, the tendency of increasingly widespread plagiarism in research activities and scientific publications becomes an important thing to examine by examining the substance of its regulation, its implementation, and the legal sanction that can be given to the perpetrators of plagiarism. The law highlighted by the researcher is Law No. 28 of 2014 About Copyright, which the Act regulates clear on Copyright in Scientific Works but does not clearly govern plagiarism. In this research used normative juridical research method with primary data, secondary data and Non-Legal Material, and equipped with model approach of Law, approach of case and conceptual approach. This research produces several things as follows. Scientific Work Technically and juridically it is clearly a creation that is protected by the Copyright Law. However, the arrangement has not combined the two related laws / regulations, so that the nature of the arrangement is not holistic and fragmentary so that the understanding of plagiarism is different from each other. The application of legal sanctions for plagiarists or copyright infringement on Scientific Works has not proceeded properly and is less in line with the purpose of the issuance of the Copyright Law and its derivative rules. The recommendations of the authors are (1) Policies concerning the prevention and control of plagiarism should be consistent with the same terms in each law as well as the rules below. (2) Prevention and control of plagiarism should begin with education to raise legal, moral and ethical awareness and enforcement law appropriately. / Fenomena plagiarisme sebagai pelanggaran hukum dan etika akademik terjadi dalam bentuk penggunaan ide, gagasan, pemikiran, tulisan, data dan informasi pihak lain dengan tidak menyebutkan sumbernya, dan semua itu dipersepsikan seakan-akan berasal dari dirinya. Upaya pencegahan dan penanggulangan plagiarisme telah diatur dalam beberapa Undang-Undang, dan peraturan pelaksananya. Namun, kecenderungan makin maraknya tindakan plagiarisme dalam kegiatan penelitian dan publikasi ilmiah, menjadi sesuatu hal yang penting untuk diteliti, yaitu dengan mengkaji substansi pengaturannya, implementasinya, dan sanksi hukum yang dapat diberikan kepada para pelaku tindak plagiarisme. Undang-Undang yang disoroti oleh peneliti yaitu UndangUndang Nomor 28 tahun 2014 Tentang Hak Cipta, dimana Undang-Undang tersebut mengatur jelas mengenai Hak Cipta dalam hal Karya Ilmiah namun tidak mengatur dengan jelas mengenai plagiarisme. Dalam penelitian ini digunakan metode penelitian yuridis normatif dengan data primer, data sekunder dan Bahan Non Hukum, serta dilengkapi dengan model pendekatan Undang-Undang, pendekatan kasus dan pendekatan konseptual. Penelitian ini menghasilkan beberapa hal sebagai berikut. Karya Ilmiah Secara teknis dan yuridis jelas merupakan ciptaan yang dilindungi oleh Undang-Undang Hak Cipta. Namun pengaturannya belum memadukan dua Undang-Undang / Peraturan terkait, sehingga terlihat sifat pengaturannya tidak holistik dan sepotongsepotong sehingga pemahaman tentang plagiarisme berbeda satu dengan yang lain. Penerapan sanksi hukum bagi para plagiator atau pelanggar Hak Cipta atas Karya Ilmiah belum berjalan dengan baik dan kurang sesuai dengan tujuan dikeluarkannya Undang-Undang Hak Cipta dan peraturan turunannya. Rekomendasi penulis adalah (1) Kebijakan yang menyangkut pencegahan dan penanggulangan plagiarisme harus konsisten menggunakan istilah yang sama pada setiap Undang-Undang maupun peraturan-peraturan dibawahnya (2) Pencegahan dan penanggulangan plagiarisme harus dimulai dengan edukasi untuk meningkatkan kesadaran hukum, moral dan etika serta penegakan hukum secara patut.
