Abstract

Living in the modern era as it is today, the world still cannot escape from acts that are against the law or what we know as tortious acts. Just as tortious acts are still frequently found, bullying, which is often heard happening in schools and the environment where a person lives, still cannot be completely dealt with. Even today, bullying has a huge impact on the lives of children, adolescents and adults. The worst effects of bullying itself include depression and lead to death. Indonesia enacted a Law on Child Protection, which protects children under 18 years from crimes committed by adults. However, based on the Human Rights Law, everyone has the right to feel a sense of security, which means that not only children should be protected by their rights, but adolescents and adults also need to be protected. Most of the time bullying lead to the aspect of criminal law, because bullying on teenagers and adults who are popular now no longer in the form of direct physical violence, but rather to also committed through verbal violence, either directly or through social media. However, in addition, one can also file a claim to the perpetrators of the bullying act through aspects of civil law, which can be linked through aspects of the torts. One aspect or element of torts requires the wrongdoer to pay compensation. Using a normative legal research, this research would cover, not only the view of torts regarding legal protection against bullying, but also the legal protection against bullying on youth and adults, with the purpose to preventively educate the readers about dangers of bullying. Therefore, this research would then conclude that bullying could be categorized as a tortious act and there is a legal protection regarding bullying on youth and adults.
