Abstract

Dalam rangka melaksanakan tujuan meningkatkan nilai ekonomi pulau-pulau kecil, Kementerian Kelautan dan Perikanan menggiatkan penanaman modal di pulau-pulau kecil. Penanaman modal di kawasan pulau-pulau kecil terbuka lebar baik untuk sektor wisata bahari, usaha perikanan dan kelautan, pertanian organik, peternakan, industri, pemukiman, perkebunan, usaha pertambangan, transportasi, maupun pelabuhan. Kesempatan terbuka baik untuk penanaman modal dalam negeri maupun asing. Untuk itu akan dibahas bagaimana implikasi yuridis berlakunya Undang-Undang Nomor 1 Tahun 2014 tentang Perubahan atas Undang-Undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil terhadap penanaman modal asing di pulau-pulau kecil serta bagaimanakah hak investor wisata bahari sejak berlakunya Undang-Undang Nomor 1 Tahun 2014. Penelitian ini merupakan penelitian hukum normatif atau penelitian hukum kepustakaan, dengan menitikberatkan pada studi dan sinkronisasi antara peraturan perundang-undangan, asas dan teori terkait penanaman modal asing dan pengelolaan pulau-pulau kecil. Dengan diberlakukannya Undang-Undang Nomor 1 Tahun 2014 maka kewenangan pemberian Izin Lokasi dan Izin Pemanfaatan WP-3-K menjadi milik Pemerintah Pusat dalam hal ini Kementerian Kelautan dan Perikanan. Secara keseluruhan Undang-Undang Nomor 1 Tahun 2014 ini lebih menegaskan lagi bahwa Penanaman Modal Asing dalam rangka pemanfaatan pesisir, pulau-pulau kecil dan pemanfaatan perairan di sekitarnya harus mengutamakan kepentingan nasional / In order to implement the goal of increasing the economic value of small islands, the Ministry of Marine Affairs and Fisheries intensified investment in small islands. Capital investment in small islands is wide open for marine tourism sector, fishery and marine business, organic farming, livestock, industry, settlement, plantation, mining business, transportation, and port. Opportunities are open for both domestic and foreign investment. For that matter will be discussed how the juridical implications of enactment of Law Number 1 Year 2014 on the Amendment of Law Number 27 Year 2007 on the Management of Coastal Zone and Small Islands against foreign investment in small islands and how the rights of marine tourism investors since enactment of Law Number 1 Year 2014. This research is a normative legal research or literature research, with emphasis on the study and synchronization between legislation, principles and theory related to foreign investment and management of small islands. With the enactment of Law Number 1 Year 2014, the authority to grant Location Permit and Permit Utilization of WP-3-K belongs to the Central Government in this case the Ministry of Marine Affairs and Fisheries. Overall Law Number 1 Year 2014 is more asserted again that Foreign Capital Investment in the framework of coastal use, small islands and the utilization of surrounding waters should prioritize national interests
