Abstract

Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun merupakan badan hukum yang ditunjuk Undang-Undang Nomor 20 Tahun 2011 Tentang Rumah Susun dalam melakukan pengurusan dan pengelolaan rumah rumah susun. Setiap perbuatan mengenai Keputusan Rapat Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun harus dituangkan ke dalam akta otentik yang dibuat oleh Notaris. Pada praktiknya, terjadi pembatalan akta notaris berkenaan dengan pembentukan Perhimpunan Pemilik dan Penghuni Satuan Rumah Susunyang disebabkan oleh kecacatan formil karena rapat diadakan ternyata diselenggarakan oleh pihak yang tidak berhak.Masalah dalam tugas akhir ini menelitipenyebab dibatalkannya akta tentang Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun yang telah dibuat oleh notaris dan aspek hukum yang timbul bagi akta notaris yang telah dibatalkan berdasarkan putusan pengadilan. Data yang digunakan adalah data sekunder yang terdiri dari bahan hukum primer dan bahan hukum sekunder. Analisis pembahasan secara kualitatif, serta penarikan kesimpulan secara deduktif. Penulismenganalisis bahwadibatalkannya akta tentang Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun karena para penggugat merupakan pihak yang berkepentingan sehingga mereka berhak mengajukan gugatan ke pengadilan dalam upaya pembatalan akta, Pembentukan Perhimpunan Pemilik dan Penghuni Satuan Rumah Susunmerupakan kewenangan Asosiasi Persatuan Penghuni Rumah Susun Indonesia dan Dinas Perumahan Pemukiman Kota Medan. Analisis terhadap sudut pandang notarisadalahnotaris sebagai pihak pencatat dalam rapat sebaiknya tetap mengetahui peraturan hukum yang berlaku di bidang rumah susun, Adanya kemungkinan unsur kelalaian notaris dalam mengesahkan akta, adanya draft terlebih dahulu dan notaris dapat meminta penetapan pengadilan terlebih dahulu sebagai upaya menghindari diri dari pembatalan Akta / Association of Owners and Occupants Unit Housing Project is a legal entity that is designated by Law No. 20 Year 2011 on the Flats in doing home maintenance and management of flats. Every action on the Resolutions of the Association of Owners and Occupants Unit Flats should be poured into an authentic deed of Notary. In practice, the cancellation notarial deed with regard to the establishment of the Association of Owners and Occupants Unit Flats caused by formal disability because of the meeting turned out to be hosted by unauthorized parties. Problems in this thesis examines the cause of the cancellation of the deed of the Association of Owners and Occupants Unit Flats that have been made by a public notary and legal aspects that arise for notary deed that has been canceled by a court decision. The data used are secondary data consists of primary legal materials and secondary law. Discussion of qualitative analysis and deductive inferences. The author analyzes that the cancellation of the certificate of the Association of Owners and Occupants Unit Housing Project because the plaintiffs an interested party so that they are entitled to file a lawsuit to court in an effort cancellation deed, Establishment of the Association of Owners and Occupants Unit Flats is the authority APERSI (Association of Unity Residents Flats Indonesia) and the Department of Housing Resettlement Medan. Analysis of the viewpoint notary is a notary as the registrar in the meeting should still know the laws in force in the field of flats, existence of the possibility of negligence notary in passing deed, the draft first and notary may request a court warrant beforehand in order to avoid themselves from cancellation deed
